hi all,
i have a question related to EE -spouse section.

my spouse is here with me in canada till july,2016(work-permit). we both are with WP's till july,2016.

i have included her in my profile so i got 458
if i remove her from my profile my score is going to 473

if i remove her then i will get the ITA in next draw(assume) so if it really takes 6 months then till January will get PR and if i submit my spouse dependent PR then how long it will take ?

i heard that if i get PR i can apply for my spouse work-permit.

please advise.

You can't remove her from the application. You must state that you're married and give those details, if you say you're not married, that would be misrepresentation and CIC takes that very seriously.

You could put her as a non-accompanying spouse but then you'd have to do a family sponsorship for her which takes longer than EE.

Your spouse cannot get open work permit after your PR. I guess, currently you are on work permit and that's the reason she has got dependent open work permit.

Thus, if she has to come to Canada after you are PR then TRV or PR are the only options left.

I haven't heard any such cases, but will be happy to see if there is any work around.
As far as I know you can get BOWP in Express Entry only if you have received 2nd AOR and I am not sure why CIC is not issuing 2nd AOR to all applicants.

But, in your case you are planning to drop your spouse from application before getting ITA itself. So BOWP will be applicable only for you and not your spouse.

I think best would be to include your spouse in your application together if you are planning to faster her application.
You can improve your score by getting band CLB 8 and above. This applies to you are you spouse too.

so only option is to improve IELTS: i have S-6.5,L8.5,R-7.5,W-7 it was done on oct,2014. can i re-evaluate now .. ?

one more question my foreign work experience i have 1 year

10 month for one employer who gave the LOR
2 months in another company who said they will not issue any letters.

so can i keep a letter of explanation offer-letter bank stments and a self-declaration form (all notarized) and also a letter from one of my colleague who worked with me(with business card).

The request for a remark must be made within six weeks of the date shown on your Test Report Form (TRF).

Points for foreign work experience 1 or 2 years + CLB 9 or more on all four first official language abilities can fetch you 25 points
On the other hand, points for foreign work experience 1 or 2 years + CLB 7 or more on all four first official language abilities can fetch you 13 points

I think in order to show work for 2 months with another employer you must attached pay stubs and offer letter/appointment letter. Because CIC is going to verify in case they want.

The pilot program is for those who already have PR and then get married outside Canada and want to bring spouse to Canada through sponsorship.


But in your case you CANNOT make application by removing your wife from the profile. That is misrepresentation and you will be barred for 5 yrs from applying if caught. You have to score points as a married couple. You can ask your wife to write IELTS and/or include her work experience to gain more points.

It also says,
New SCLPC applicants should complete a permanent residence application and an open work permit applications, include the appropriate fees, and submit both simultaneously to the Case Processing Centre in Mississauga.

This notification was prior to start of Express Entry, if I would be in your position then I would definitely call CIC for further clarification.

:) Ok so after posting this same thing couple of times, we don't have a clear answer for this yet. One thing people have to understand is that applicant CAN say that they are married BUT may not include spouse in application - and this is very much doable. Omitting that one is married from the application is obviously a dumb thing to do and NOBODY is asking to do that. So stop pretending serious queries as if you know it all and the person asking question is going to omit his married status from the application. I hope we are not that stupid here.

Having said that, here is my response to this important post that many are struggling with:

I am kind of in the similar situation. I am at 457 when my wife is coming with me otherwise I am at 477. Now both of us are in Canada. What I have learned so far is that you can very well choose to apply alone (married but wife not included in PR app.) but spousal sponsorship after you get PR takes more than 2 years in processing. That is the official times on CIC website for spouses who are already in Canada. In this case though, "in Canada" spouses can apply for open work permit and hence can be granted a TRV (I am assuming this based on OWP). But a long processing time is a huge downside for this. So you will be PR but your wife will get it after 2 years of you getting PR. It depends on personal scenario whether to go ahead with this or not.

On the other hand if you try to improve your score to 470+, you are very likely to get ITA in a month or two. Shoot for 480+, you will land 470+. Try to improve score in IELTS/CELPIP. Thats the best you can do if you dont want to wait for 2.5 years from now. Thats what I am doing. :)

thanks for the info UXD.

this oct-2015 my 2 years CAD exp will complete. so i will jump from 458 to 481.

in IELTS i have S-6.5,L8.5,R-7.5,W-7 it was done on oct,2014

so planning to improve my score. speaking made a big difference. if it was atleast 7 i would have jumped to 477 now and after oct,2015 to 500.
