DUI Question

Hi Im new here and contemplating moving to Canada from the U.S. My question is that my spouse was arrested for a DUI earlier this year but when tested in jail, his blood alcohol level was not above the legal limit. He was then released with a court date to return, we have then had 2 more court dates where the court and then our attorney have asked for time to prepare. Our attorney has said that the charges should eventually be dropped, and if this is the case would it be considered a DUI offense for inadmissability? I know that I will probably have to seek legal advice but I am hoping you can provide me with your opinions. Thanks in advance

1. Wait until you received the results of the charge. If there is no conviction or he is found not guilty your fine.
2. If he is found guilty of DUI, then he is then inadmissible to Canada as both a visitor and an immigrant. He could not apply for rehabilitation for 5 years after the end of the sentence.
