Hi everyone. I have a quick question. I am a US citizen and my husband is a Canadian citizen. My 6 months old baby was born in Canada so he is a Canadian citizen through birth. I know he is automatically a US citizen bc of me. I need a prove such as a document stating that. I tried to apply for an american passport but they needed a US social security number. So I went to US social security office. They said we cant give him a number bc there isnt a prove he is citizen through birth. They told me to go to the immigration office which I just came back from with no luck.

The immigration office told me they can't do anything about it and I need to go to a Canadian embassy to request a certificate of birth abroad. And now I am searching online it says I need to go to a US embassy.

Please someone help me here.

If you are in Canada at the moment have you been to your nearest US consulate general. They should be able to direct you through the necessary requirements? Otherwise this info might be helpful.

Evidence of U.S. Citizenship

You must submit one of the following original documents as primary evidence of U.S. citizenship for your child (photocopies are not acceptable):

Certified U.S. Birth Certificate (must meet all of the following requirements):
Issued by City, County, or State of birth
Lists bearer's full name, date of birth, and place of birth
Lists parent(s) full names
Has date filed with registrar's office (must be within one year of birth)
Has registrar's signature
Has embossed, impressed, or multicolored seal of registrar
Previous U.S. Passport (may be expired, must be undamaged)
Consular Report of Birth Abroad
Certificate of Naturalization/Citizenship

Hey so where do I get all these from? And send it where. I already have been to the US immigration office in michigan and they told me I need to go to a Canadian embassy. And when I was searching online it says I need to go to a US embassy. Is there like a phone number or an email so I can contact them? I am going in a circle I swear. Lol

Because the child is born to a single American parent does not automatically mean the child gets American citizenship, like child of both parents being americans. There are rules in being able to pass on American citizenship to the child from a single American parent. So the single American parent can pass on citizenship by descent if the parent has lived in US for at least 5 years, 2 of those years occurred after the age of 14 prior to the child's birth. I am sure you are fully aware of it. I just wanted to clarify your post "automatically American because of me". That implied that single American parent can automatically pass on their citizenship, which is not the case.

I have a friend who is born American to canadian parents and moved to Canada at age of 16. When she tried to pass American citizenship to her child, the US authorities literally counted the time she was in US right up to the day she left Us. She barely meet the requirements, passing the 2 year after 14 years of age by 7 days.

I think your best bet is to contact the American embassy and explain the situation and would like to pass on American citizenship to your child. They will likely give you instructions on how to go about it. They may instruct you to prove your residence time in US first before moving on next steps.

Hi. I spent years trying to figure out how to claim my American citizenship through my father. He qualified for the number of years of residency in the US but I couldnt figure out how to get all that paperwork either as they did not register me at birth with the American Embassy. I phoned everybody from American immigration to the embassy here in Japan where I live. I went to the embassy in Vancouver and nobody had answers for me about how to apply for my American citizenship. Finally in a little post office in Port Angeles where my parents presently live, the guy told me to just apply for the passport. All I needed was my father's Birth certificate and my extended canadian birth certificate proving that he was my father. As well as his addresses is in the United States and all the other required information. But I didn't need to Social Security number or any other proof of American citizenship.

Give it a try. The guys were very helpful at the passport offices

Are you sure you would even want to apply for American citizenship? You'll bind yourself to a lifetime of paying and dealing with the IRS.

Sometimes even though the child is born in Canada to an American parent, or parents, the IRS still sees the child as American, despite never applying for it. There has been cases of this happening.

We just got the passport application and filled in the relevant info. You need other iD I think for your child like a Canadian passport or maybe med card. Sorry, can't remember those details but yes, we just sent in my extended Canadian birth certificate listing my father as my father, his American birth certificate, his list of residence in the States and, oh ya, my parents marriage certificate. It was difficult only in the sense that so much of the info was so dated. You should have no trouble. Please let me know if there is anything else I can help with but first I would get an American passport application and go from there.

Again, I was so surprised how easy it was as I had spent literally years phoning immigration and embassies looking for the answer. And yes, you should think about the tax consequences. But for me, my parents now live in the states and I'm there back and forth across the boarder all summer. It just made sense to have both passports.
