Hello all, as I'll be planning to move and work in Canada, my family (wife and kids) will be travelling with me. I have applied work permit for myself, open work permit for spouse and visitor visas for my kids aged 6 years and 5 years. Just recently I see few people mentioned their kid's visa got refused and they have been asked to submit a study permit.

My employer was too confident and asked me to apply visitor visa - all other types for both my kids. Now I'm in doubt what should I do, wait for the answer from IRCC or withdraw and submit study permit for my kids?

Assuming they will be going to school and as per my employer they should be issued visitors record at POE and should be fine to attend school.

Any replies will be appreciated!

Would suggest applying for a study permit now. Most VOs now require children over 4 to apply for a study permit. You don’t need proof of acceptance from a local school. Assume your job is NOC 0, A or B.

Hi, thank you for replying.
So can I withdraw application now only for my kids? and submit it again as a study permit. or do I need to withdraw all the applications since we submitted together.

You can submit the study permits in addition to the TRVs if you want. Would attach a letter of explanation explaining that you discovered that a study permit would be the more appropriate visa versus a TRV. Did your spouse apply for a TRV with the children or did she apply for an OWP? Depending on how you submitted the TRVs I wouldn’t want your wife’s application to accidentally get cancelled by accident if you withdrew the children as part of the family TRV application. You can withdraw the children as part of the TRV application but would make sure you explain that you withdrawing the children’s applicatio so you can submit a study permit application for them. What is your timeframe for coming to Canada?

I understand, well thank you for the response!
I am the primary applicant, applied for a WP, wife applied for OWP and kids applied visitor visas. So in the LOE I can just write about the doubt and can mention if study permit is more suitable then can proceed with that application for KIDS only,.

Yes that should be fine. Your children likely would have been on a separate visitor visa application if you and your wife applied for WPs and if that is the case it would be easy to withdraw the visitor visa for each child. Really depends on how things were filed. You could submit the study permits and then withdraw the TRVs. I don’t trust government agencies not to make errors so would make sure to keep any emails requesting any changes to your application and would also include an explanation.

Right now we have applied as accompanying family members. But as you said to apply for a study permit for my kids, how do I do that? That looks like a whole new separate application where the primary applicant is going to be the child. Can you pls explain this

Hello, I also have same issue? What did you do to resolve it? Was your application approved?
