Does my wife have implied status? Applied inland

Hey guys,

We sent our application Feb 13th 2017, and according to Canada post says its out for delivery since Feb 15th 2017, I called Canada post and they said it won't have another scan because it went to the mail room for the CIC. We haven't heard anything from the CIC yet. My wifes visitor visa expires April 14th 2017, but I'm wondering if she has implied status because we sent the application? Do we need to extend her visitor visa with the official receipt for the spousal application and open work permit? And if we do, whats the chance of it being rejected/approved?

Did you include an open work permit application with her inland application? To have implied status, you need to have included an OWP application with the inland sponsorship application. The sponsorship application itself isn't enough to grant implied status.

Just re-read your post. It sounds like you included an OWP - in which case she has implied status.

Having said that, I would personally still extend her visitor visa. We have seen several cases on this forum where inland applications are returned due to incomplete or missing forms / signatures. While the chances are small, if this happens to you and you received the incomplete application after her visitor visa has expired, she would then be out of status in Canada which makes the resubmission of the inland application much more complicated. I would apply to extend her visit as insurance.

Thank you for the reply! We are still waiting for an AOR from the CIC but will apply for an extension 1-2 weeks before her visa expires. Will my wife be accepted easily because of the implied status when applying for the visitor visa extension? As I mentioned we don't have the AOR so I'm curious if they'll extend the visitor visa without that number? We do have the receipt for both work permit and sponsorship application, could that work?

I'm more concerned your app still says "out for delivery". That's not normal afaik.

The implied status, if she has it, isn't going to have anything to do with visitor status. If she has implied status now it makes the visitor status redundant, so you are just doing this as a backup plan.

Yes provide the receipts. You don't need the PR application number, again that's nothing to do with visitor status. If you had AOR then you'd not need the visitor status extension.

I called Canada post to escalate it, they are filing an investigation. They did mention however that its normal to say "out for delivery" because it goes to a large volume receiver (CIC in this case), and doesn't get received until someone picks up the packages. Its the second time I called, this time I demanded an investigation. I asked about it on this forum before and everyone was telling me that it takes 1 month to receive an AOR and that I shouldn't worry. Hopefully I'll have more news in 5 Days. Thanks for your reply!
