Dear Friends,

My friend is a Permanant Resident in CANADA and sponsored his wife's PR. They have been married for 1 and half year. She landed in CANADA few months back.
Her intentions of marriage and coming to CANADA are different(for money).

He wants to apply for divorce. He is married in india. Can he go back to india apply for Divorce? or does he needs to apply for divorce in CANADA.
Can he send a letter to immigration to cancel her PR incase if they apply for divorce since she cheated him.

Need some information on this.

He need to apply for divorce in the place were he lives...
He need to serve his wife to the place where she leaves,
there are companies that specialize in serving divorce papers... he can not serve in person.

The process may take one year or more...

He can not cancel her permanent residence,
its up to Immigration Canada to revoke her residence.
He can inform Immigration about the divorce if he wishes...

But he still will be responsible for her expenses until the Conditional Residence period finalizes,
If she go to welfare he is the one that has to pay back all that money according to what he agreed
when he submitted her application.

Hi

As long as he has been living in Canada for at least a year, he can apply for a divorce in Canada. However, unless he can prove she committed adultery or has been abusive, he will not be able to file for divorce until they have been legally separated for a year.

He is required to inform CIC about the breakdown in the relationship. If the wife is subject to Conditional PR, CIC may revoke her PR. This is a new rule and very untested, so no one can say for sure what will happen to her PR status.
