Does a sponsor living outside of Canada weaken our application?

I am aware that most of these questions have been answered here, I'm just hoping someone can shed light on our particular case.

- My wife and I were married last week.
- I am American, she's Canadian.
- I am going back to the US to teach for the spring semester.
- Currently she is employed in Canada.
- OUR PARTICULAR CASE: She is going to move to the US in May and we are going to live and work there until I get PR in Canada.

Questions:

1. Do we apply inside or outside? I'm guessing outside. Please confirm.
2. Will it weaken our application if she is living in the states for a year until my PR comes through?

In other words, if my wife is sponsoring me, must she remain in Canada for the entire duration of our application process in order to remain a valid sponsor, or is a year or even two years living in the states not a problem?

Assuming your wife is a Canadian citizen (rather than a PR)...

1) You must apply outland (i.e. outside of Canada).
2) Your wife can live with you in the US while the application is being processed. However she must include proof/evidence as part of the application that both of you will return to Canada once your PR has been granted. Proof is typically a combination of: rental agreement, mortgage, job offer, written summary of plans to settle in Canada, etc.

Thanks for your response. I need a further clarification.

When my wife (yes, a citizen) sends in the application (sometime between now and April) she will still be living and working in Canada. After that, she'll be moving to the States (May or June). So, in the application, should she present herself as her current self (the working and living and Canada one) or the future self (the one who will be living in America and has plans and a mortgage to come back to once I get my PR)? Because if she fills out the "I'm employed in Canada" section AND the "I don't live in Canada and will be returning once my husband gets PR and I have a mortgage, etc." then isn't it contradictory? Is there a way on the application to express the full story? or should we just keep it simple and apply in our current configuration (which is her working and living in Canada)

Does that make sense?

Is your wife going to be moving to the US to live there exclusively? (as in will she be ceasing all residential ties to Canada and going to work and have a lease etc in the US?) From the sounds of it to me, she is a Canadian who is planning to go visit you in the states for an extended period of time while you wait out your application. In which case she is NOT a Canadian living exclusively outside of Canada and then you would just apply saying she is in Canada and leave it at that. The only thing to remember is that you need to give an address for her that she will be able to continue receiving mail at once she has moved in case Immigration tries to contact her. I don't think it effects your chances as an applicant in any way whether she is residing on Canada or not (as long as you provide proof she will be returning) but it is one less piece of documentation that you need to prepare and that the visa officer will have to review so rather skip it I would think.

I applied as living exclusively outside of Canada but I've been living and working overseas for several years, have no home currently in Canada, don't receive medical benefits, etc.

Then I'd say include a statement somewhere saying that she will be travelling down to the US for an extended visit during the application period so that you can be together.
