Do I qualify residency obligation under the 'affiliated enterprise' clause?

Hi,

I landed Canada with my family in Nov 2003 and returned after 2 weeks. We live in the UAE and have not visited Canada since our first landing. Our PR cards' validity expired in Nov 2008. Obviously we have not stayed in Canada for the required period to maintain the validity of our PR cards (i.e. 730 days during the last 5 years)

I am unsure if I comply with the residency obligation while working abroad. I work in a company in the UAE, whose head office is in London. Our London office has a branch in Canada as well. Will I qualify the residency requirement under the ‘affiliated enterprise' clause? The UAE company I work with is not a branch of the Canadian corporation. Both the Canadian and the UAE companies are branches of the same parent company headquartered in London.

No, you would have had to be hired by the Canadian office and then transferred to an overseas operation.
