Do I need to leave Canada while waiting for a WP reply ?

Hello everybody,
First of all, thanks for all the help you can provide me clarifying my doubts.

I have a work permit that will expire the 15th December.
The paralegal services that represent me already sent the new application in early November.
They claim it's a brand new application, like the one it was made when me and my family came to Canada (1 year ago).
Is this true or could I just ask for an extension ? (with a new LMO)
In the meanwhile, can I get "implied status" or do I need to leave and re-enter Canada ?
They wanted me to apply for an extended tourist visa, make an insurance for all family members, send a letter from the bank stating we have money and a lot of stuff - including more money for that process (and btw, they would also be able to make that insurance...) - we are already paying quite some money and It seems they just want a Xmas bonus and make our life harder...
Will I need another 3 month period to get a OHIP card renewal ?

Hi,

You would be on implied status once your current WP expires on December 15.

You do not have to leave Canada pending the outcome of your WP application & continue working if you have not changed the employer. Certainly you don not need to apply for tourist visa although buying insurance for you & your family for a month or two would not be a bad idea.

Do I get the implied status even if the LMO has not been issued ? For the implied status don't I need to have a number of my request/application for a renewal ?
Also, I was told by the pl I could not apply for an extension but had to go through the initial process all over again - thus not having an application for a renewal but an application like I was in my country of origin.
Is there any legislation I can check ?

Hi,

Yes you would be on implied status even though you don't have a confirmed LMO on your WP application but you have to ensure that you apply for your WP before the expiry of your current WP (you can ask the PL to provide you with a proof of submission of application).

The paperwork involved is same whether you apply for a renewal or a new WP except that inside Canada you don't require a medical test for WP. If you could be more precise what is troubling you with your PL perhaps people on this forum can offer you advise.
