Hi,
I'm in a common law relation living in Canada. My partner is sponsoring me as spouse in Canada class and I'm currently under a "temporary resident as student" visa which will be valid until september of 2009.
I'll apply to the "permanent residence" within a month. I know it'll take a long time until I got an answer from immigration offices and I don't know if I should apply for an extension in my "temporary resident visa".

What will happen if I got the permanent residence but I don't have status? Do I need legal status?

Thanks so much for your answers!

Jose

I understand that you are applying from inside Canada, then yes, it's important to extend your Student permit while your application is under process. Failing to do so will mean that you'll be staying illegally in Canada for a periode of time, & you'll have to pay a fine of $200 CAD. (which could also have a negative impact on your Application)
you should apply 45 days before your current student authorization is expires.

If you are not a Canadian citizen OR a permanent resident, It's illegal to study in Canada without a student authorization!!

So try to maintain your status until you PR application clears & is approved, or you will be studying illegally as well.

P.S: I knew a few people with a U.S citizenship, that were deported from Canada, only because they didn't renew their Student Authorization, & been prohibited from entering Canada for up to a year.

Good luck.

Wawaprince,

Thanks so much for your answer and your example. It's always good to know second opinions.
I'm currently applying for a change of status, from student to visitor.

Thanks!
