Hi,

Our live in caregiver is needing to reapply for her work permit (she just arrived last January). There is some question whether we need to get another LMO at this time.

Can anyone clarify?

Thank you,

A

I can't get your question. Refrain me if I'm wrong. Anyways, how come that she needs to re-apply for her work permit? Does that mean that your name (employer) is not the one listed on the Caregiver's existing Work Permit? Not unless s/he's holding an OWP (Open Work PErmit) If that's the case then YES. The employer needs to undergo the process of advertising (that NO permanent residents/citizens applied for the job); then the employer apply for an LMO; then the prospective caregiver will apply for a new work permit. The caregiver is not allowed to work with the new employer until s/he will get her/his new work permit.

If it's a case whereby she needs to renew her work permit with u her current employer, then no she does not need a new LMO. Just give her an updated contract signed by both of u and she can apply to renew online. She sgould ensure thaat she renews her work permit in adequate time because OHIP and SIN will expire whenever her old work permit expires and she will need her new work permit to renew them.
