Hey there,

I am PR here in canada. and i am heading for a divorce. I am going to do all the procedure at back home to file a divorce. Now backhome they have a procedure that i have to fill out an form and then they will issue a divorce pepper on which i, my ex husband and an authorized lawyer will sign. also two-three witnesses sign. they take id of all and pictures. and after that the office go for a notary stamp. so it becomes notarized paper with all signs and , ids and pics as a proof. So is this paper valid in CIC?? to show that i have done an official divorce??

If you are already a PR, why do you think CIC needs your divorce certificate?

If this is the legal court procedure for a divorce in your home country, it will be recognized in Canada.

If you have been resident in Canada for 1 year, you can divorce here.

1. For the divorce to be valid in Canada in must meet the following in the Divorce Act of Canada.

Having a foreign divorce recognized in Canada

Canada generally recognizes a divorce from another country if:

the divorce was valid under the laws of that country; and
one or both spouses lived in that country for a full year immediately before applying for the divorce.

There may also be other factors that could affect whether or not your divorce would be recognized in Canada. If you are not sure whether your divorce would be recognized in Canada, you should speak to a lawyer.
