Hey guys…couple of questions:
Me and my common law partner applied as skilled worker and got our AOR in January. So we have 120 days to send our documents to Buffalo. In the meanwhile my partner got accepted at the university in Canada. We are planning to apply at Detroit for a study permit.
1. I got the AOR for skilled worker, but didn’t send the documents to Buffalo. Are we in their database? (immigration database)
2. If we are in their database for skilled workers, do u think that we will get the study permit or we will have difficulties? I know that for a study permit we have to convince the immigration officer that we are planning to return to our country after finishing studies in Canada.
3. We are going to send out documents for study permit next week. It is a bad idea to send my documents for skilled worker at the beginning of May (when basically is our deadline for skilled workers; 120 days)
4. Is there any chance to get back the fees we paid for skilled workers? ( $1000 or so)

1. Yes, you are in the CAIPS system.
2. If your spouse meets the criteria for a study permit, and has funds for the international fees, plus $14K for living expenses for the 1st year, then a study permit may be issued.
3. There is dual intent.
4. You can withdraw your application and get your fees back, but you have to ask "do you want to be PRs in Canada or not?"

1.Yes. As soon as they enter your passport details to FOSS (Field operational security System) as well as CAIPS, all your details are just at their fingertips. (got these details from my uncle who is an imigration lawyer in Canada)
2. what you can do is to withdraw your application for FSW and continue with your study permit. (But you may have difficulties). Convincing your visa officer of your return to home country at the completion of your studies in Canada is now in doubt. If you are denied student permits, that might have negative effects on any future FSW application.

3. I have no clue as to what you should do, continue with your study permit or FSW. From general point of view, we could see nothing wrong changing your plan from FSW to international student. But, we know that visa officers are always after negative points. Right?
4. Yes. if you withdraw your application for FSW, they will probably do full refund which might take upto 4-6 weeks.

i dont know..why all of them are giving u suggestion to withdraw application....most of people on buffalo link are opting for student, work or visitor visa....so that they may not go out of status....i think its all luck...that you will get visa or not....go ahead ...submit your application..

see there is separate category for international students nd workers in fsw....then CEC...THESE R ALL FACIliTIES GIVEN TO STUDENTS so tht they can settle down here
