Hi everybody, a difficult question (at least for me, of course..):

I have a relevant experience of more than 4 years in (at least) two noc of 0/A fields; at the moment I am in Canada but I got a very good job offer in a totally different field (noc B, cook, noc 6242) in which, unfortunately, I do not have two years of experience yet.

Considering your experience, I am eligible for FSW program?

Cooks are not included in the FSW program. May be you can look into FSTP and check if you can apply. But without any prior experience in this NOC, you probably won't qualify to apply.

"We will only process your FSW application if you have:
at least one year of continuous and paid (full-time or an equal amount in part-time) work experience
in a single occupation,
within the last 10 years,
at skill type 0, or skill levels A or B of the 2011 edition of the Canadian National Occupational Classification (NOC)
AND
You have this work experience in one of the eligible occupations,
OR
You have a valid offer of arranged employment,
OR
You are an international student who is enrolled in a PhD program in Canada (or who graduated from a Canadian PhD program within the past 12 months) and meet these criteria. "

As you can see is not mentioned that the valid job offer is in the occupation in which I have experience...
and, anyway, in theory it seems that the job offer is not mandatory in case you have experience. Is it correct?

since the whole of FSW system and points system is overhauled. u can check for the rules of new Express Entry system. for FSW its quite late

The new express entry is based on the "old" rules for skilled workers, trades and cec...

You are right, but the job offer has to be permanent and LMIA approved to be qualified under arranged employment category under FSW. Do you have those? If you do then you will be eligible to apply.

Yes my job offer is permanent and I do not need a LMIA because I fall under the provincial nomination.

I am planning to apply to EE and I need to understand if I can fall under the FSW....

Not true. PNP and FSW are different programs and the requirements will remain different. Express entry is just a new way to submitting applications with new points criteria. But, the minimum requirements WILL be different for different programs under the express entry. Whatever the minimum requirement for your PNP is currently, would most likely remain the same. So you can prepare your application based on the current requirements for your PNP and keep checking to see if anything would be changed in the future.

If an applicant gets a nomination from a province or territory, they will be given enough additional points to be invited to apply for permanent residence at the next eligible draw of candidates.

Just as they manage their own Provincial Nominee Program (PNP) now, provinces and territories will set the criteria they use to nominate Express Entry candidates.

Express Entry candidates may either:

enter the pool first, and then be nominated by a province or territory; or

How can you explain the last sentence? I thought (hopefully in a wrong way) that, in order to apply under the new EE (PNP stream), the applicant have to fulfill both PNP and "at least" one of the other federal programs (FSW or trades or CEC). Am I wrong?

^EE candidates have to only satisfy CEC/FSWP criteria. Why do you need to satisfy PNP criteria again when you already have the nomination? You just have to make sure the nomination remains valid.

Can we apply through both routes with provincial nomination?

Traditional PNP route and EE?

Can we use the same nomination certificate for both these routes?

At least one of the federal immigration programs means either FSW or CEC or FSTP. These are the federal programs managed through express entry. So, you would be nominated by your province and then choose one of the federal programs (FSW, FSTP or CEC) under express entry.

Also, based on this "Provinces and territories will also be able to recruit candidates from the Express Entry system for a portion of the Provincial Nominee Programs to meet local labour market needs." it looks like there would be a separate PNP program in place independent of the express entry program that are not dependent on the federal programs.

This is exactly the point and the sense of my original question.
I hope to get my PNP sponsorship soon, and then I have to fall into one of the federal cathegories.

My only suggestion for you is that you can enter all your information online in the express entry system. If the system is smart enough, then hopefully it will let you know if you qualify to apply under the FSW program. My feeling is that you will be eligible.
