Difference between Spouse and Common law parrtner

Hi

We are applying for our dependent daughter PR and my Wife is co-signer of the application.
1) Do we need to submit IMM 5409- Declaration of common law?? Since we have already our certificate of marriage.
2) Do my Wife also have to submit IMM 5440- Sponsorship Questionnaire.

If you are legally married, you can ignore any common-law related documents or questions.
