DESPERATELY NEED A HELP -Married to a Live in caregiver !!

Hello Leon, PMM and everyone who is reading this post. GOD Bless you all .
Need your help .

I am a Canadian Citizen (husban)who is married to a live in caregiver(wife) currently and her visa is valid until sept 2015, I have sponsored my ex-wife from oversease and she became a landed immigrant(Canada) in Aug 2011 then the marriage lasted 2 years and we got divorced, a final judgement was issued and the divorce was finalized. My question is

1)Do we have to wait for the 3 years period time to be elapsed (Sept 2014)to sponsor my new Wife or Can I just proceed with the application now ?

2) How long does the sponsorship(inland) process will take ?

3) Does she need to change or extend her condition of stay in Canada from live in caregiver to visitor until the process of the PR will be finalized ? afraid of her visa expiration .

3) When submitting the application for PR, do we need to include an application of an open permit as well ?

4) Does she need to continue with the live in caregiver program until the completion of her 24 months ?

Please help !!

Hi, welcome to the forum.

BTW she is not a "landed immigrant" until she gets 'PR', the two terms are somewhat synonymous.

1). No, you don't have to wait, but you still include your previous sponsorship in the questions concerning 'previous undertakings'.

2). Inland is much longer than outland. What VO (country) did she come from? Are you aware that even though she is here in Canada you can apply as "outland"? We did exactly that.

3). No, she can remain as a 'caregiver' or maintain caregiver status until her work permit expires. In part why I suggested 'outland'.

3). Only if you still decide to proceed with an inland application, for outland this is not an option.

4). No she doesn't.

As for my- ex wife she received her PR in canada, she was from the usa ..then returned to usa for good .
As for my current wife she is from Malaysia . So do you think the 3 years waiting period doesnt apply to me ???

What else should I include in the PR application (extension of stay in Canada, open permit etc..)? Her current work permit end Sept 2015.

Ah yes, I see you were referring to your 'ex' with that term.

The 3 years "undertaking" DOES apply to you, but it doesn't mean that you cannot submit another application as a sponsor for PR. If you still wish to apply 'inland' then yes submit also an application for OWP. If you decide to pursue this as 'outland' then don't submit or include anything else.

1. You can't sponsor a new spouse until 3 years after your previous wife "landed" So you have to wait until Aug/14.
2. Presently, 8 months for 1st level decision, 8 months for completion 80% of applications.
3. If she is not working as a live in Caregiver then she would have to apply for an extension as a visitor, if she is still working as a "live in" then you are going to have difficulties with your sponsorship.
4. You know that "in-Canada" go to Mississauga now, which doesn't process work/visit/study permits, so she would have to wait until 1st level approval and then submit her OWP to Vegreville (CIC has made any statements about this, since the change to Mississauga)

So When I am submitting the sponsorship application in Sept 2014 do I have to include her application for OWP as well?
or Do I need to wait for the first stage approval then submit her OWP application?
