I am a PR card holder of USA recently married to my spouse (Canadian Citizen) and I stayed in Canada for almost 6 months. Exactly 1 month before my 6th month in Canada I decided to go to Buffalo with my brother in law and mother in law for shopping purposes. Upon entering Canada, My brother in law accidentally said that I am living in Canada (which I should only be a visitor) and I had to deal with Canadian Immigration Officers and I tried telling the officers that I am unsure of my plans (which is my fault) and I also have an almost expired passport which expires before May. They gave me a a form that I must leave Canada on a said date and said if I want to re-enter I must either prove to immigration that I am coming as a visitor (providing evidence that I wont stay for long) or have plans on staying in Canada (giving marriage certificate and PR application)

I am close to submitting our PR application since we are waiting for my FBI clearance.

As of now I don't know whats the best solution to my scenario and what to say to immigration officers once I try to re-enter Canada.

Can anyone please help me?

Thank you.

You need to provide a clear plan that you plan on leaving Canada. If you are taking commercial transportation, a proof of return ticket leaving Canada helps. Showing strong ties to the US (job, lease agreement, etc in the US) helps too. You must also make it clear when you talk to them that you know you are a visitor and that you plan on leaving Canada on a certain date. You will also need to renew your passport

This form they gave you is it just a vistor record stating you must leave by the date printed on it?

With your already ongoing issues with CBSA I would suggest you don't leave the country at all until that application is submitted and you have an AOR in hand otherwise you could risk them giving you an exclusion order for not having any proof of ties to the US and/or intent to return. That last thing you want right now is an exclusion order because that would have to be served fully (usually 1 year for your type of infraction) before you can even get your PR application started.

All I can suggest you tell the CBSA is the EXACT truth. Don't make up stories or tell them what you think they want to hear. Be completely honest with them and hope for the best.
