Hello everyone,

I first arrived in Canada 2007 when I studied one year at the Capilano College in Vancouver. Met my girlfriend in Vancouver and have been trying to do everything right over the span of six years.

I had a student visa 2007-2008
Workvisa 2009
Back in Finland 2010
Tourist visa 2011-2012 (extended it)
Workvisa 2012-2013

I moved to Edmonton since I could not find work in Vancouver. I worked one year and went back home on a holiday, this summer. My employer applied for a LMO but he forgot some paperwork so it got heavily delayed and did not arrive untill this month October 2013 even though he started working on it in February.

Since I the LMO was supposed to clear before my trip i booked it and made plans. The last moment I realized it will not clear so I called cic, studied the webpages and applied for an work visa extension. This was a mistake that backfired hard I think. When I flew back to the country after my one month holiday in Finland from July-August I could not continue working while waiting for the decision for my extension. So they gave me a tourist visa for three months and told me to wait for the extension / LMO to clear.

The extension got denied in September and told me to leave the country but since I already had left the country and came back with a tourist visa I did not need to leave the country.

I got the approved LMO last week 14 of October and went to the border yesterday 20 of October. At the border they took their time before taking me up to the counter and the started questioning me about why my extension got denied and why I had not left the country. I explained that I left and came back as a tourist waiting for the LMO and he said "OK OK my misstake you did the right thing" He then asked I had worked illegal and i said no. I did work for 7 evening / days while waiting for my LMO to clear in a period of 3 months. I did not think nobody would ever find out and needed the extra money. I mostly did work on the evening helping my boss build a garage etc.

The border agent then asked for my phone and I had not idea what was going on so I just gave it to him and he said he is going to read my text messages and see if I have worked in Canada. He asked if he is going to find something and I panicked and said no. Of course he was going to find some messages between me and my boss. I *censored word*ed up. He then calls me a liar and decides to deport me right away, he says he is being fair since he could escort me to the airport right away but instead he gave me 2 weeks of time to sell everything I have and leave.

So right now my life is ruined it feels like. I have sold everything I have in Finland, I have a approved LMO but since I worked 7 days while waiting for over three months for it to clear I am getting deported and can not even apply for any access to Canada for 6 months. I have been with my girlfriend for over 5 years and we are being torn apart. Due to all the waiting I have used up all my money since I was sure I could continue working when the LMO arrives.

My question is:

1) Is there anything I can do to not get deported in two weeks?

2) I am now a flagged person so I doubt I can get a new work visa is my only option to marry my girl friend and apply for residency
b) If I apply for residency under her sponsoring me as a married couple will it take 6 months before I can apply and then X months for how long the application takes?

Any help right now is worth more than gold, thank you.
 
Have you received an actual deportation order? You mention a deportation order in the subject of your email but not in the write up of your situation.

Yes I have a deportation order which says I have to email a flight ticker before October 31 and leave the country no later than November 3, 2013
 
The deportation order is a serious matter and you need to follow the instructions you have been given to the letter. Failing to follow the instructions you have been given and leave Canada by the stated date will just make your situation worse than it is today. It's really too bad about the illegal work and no surprise you were given the six month ban from applying (that's the normal penalty for illegal work).

You're right in assuming that it will likely be more difficult to obtain a work permit in the future due to the illegal work. How difficult - none of us here can say.

Assuming your relationship with your girlfriend is serious, then yes - I think it would make sense to get married and have her sponsor you for PR. London is the processing office for outland (outside of Canada) spousal sponsorship applications. As for processing times, it will take approximately a month for your girlfriend to be approved as a sponsor by the Mississauga office. After than the application will be transferred to the London office which currently has a processing time of 10 months. The 10 months is how long it took that office to complete processing for 80% of applications. This means that many get through faster - some substantially faster. Difficult to say what your experience will be (your application may be examined much closer due to the illegal work / deportation order). You can see the processing times here:

Going to go see a lawyer today here in Edmonton by the name of Shriish Chotalei I hope she is worth the counseling of 250$/30 minutes.

I will report back with what options she has for me.
