I would appreciate if someone has some up to date info for me. I am a Canadian citizen who was deported from the US 22 years ago. It was so silly, I held a valid passport but was traveling with someone who was a refugee claimant in Canada. We snuck across the border at Blaine Washington. Later we were found and put in an immigration detention center. We spent close to 1 month there before I was deported back to Canada and my friend to his country. My passport was confiscated and I was eventually escorted back to Canada. I would like to travel to Mexico with a friend for vacation, but don't know if I will be refused entry. I have not yet applied for my passport because I'm not sure I will be granted entry. I understand there is a time limit after being deported before a person can re-enter. After that time has elapsed can I just enter lawfully or is there a process to follow? Help!
 
I'm not sure I understand your concern. You're worried about being denied entry because you overstayed in the US? Do you have a stop over in the US?
 
Well I guess the reason for deportation was for illegal entry, I was quite young at the time, really dumb. Anyway, yes, if I have a stopover will I have problems? Also not really sure if I will have issues with entry to Mexico? I asked Canada immigration and they told me to call Border Services, I e-mailed with detailed explanation and am waiting for reply. Who knows when or if that will happen!

I just want to know if after 22 years there is a process to go through? I am understanding from various government and immigration lawyers websites that there can be a 5, 10 or 20 year ban for re-entry. If you need to enter before that time period has elapsed there is forms and fees, but if enough time has passed is it as easy as applying for a new passport and booking flight and off sipping margaritas in sunny Mexico? Does anybody know? Thanks so much. 8)
 
If you are not entering the US on your trip, you shouldn't worry. You think Mexico knows that you were deported from the US 22 years ago? I would think not.

If you want to make a stop-over in the US, you should be talking to the US embassy about that. You can apply for a visit visa to the US even though as a Canadian, you don't really need one. By doing that, you force them to look into your case ahead of time and make a decision about if they want you to enter the US or not.
 
Talk to the US embassy before you make travel plans involving the US.

Canadians can typically travel to the US under the visa waiver program - meaning they don't need a visa to enter the country as a visitor. Certain immigration offences result in never being able to use the visa waiver program again. You need to determine if EWI (entering without inspection) is one of them. If you no longer qualify under the visa waiver program then you will need to apply for a visa every time you want to visit or transit through the US.

Definitely check before you go. Unlike Canada, the US takes a much much much stronger position on illegal entries and overstays. If you try to re-enter under the visa waiver program but are no longer eligible to use it, they'll slap you with yet another ban. They won't care if you know or not.

Make sure you make it very clear to the Embassy that you both entered without inspection and were deported.
 
Thank you Scylla for taking time to post. I guess I should be pro-active in contacting the embassy. Now I am curious if it is as simple as making an appointment and asking those questions (of course providing ID and details surrounding incident) or if there is a big run around and cash grab that I will be subjected to.
