Dependents over age 22

Hi,
My Dad applied for Canadian Immigration under Federal Skill Program in year '02 under the Canadian Job occupation list 2113.0 as an Oceanographer. At that time, the immigration application was in finalization process and we did our medical tests and we were instructed to provide a proof of funds for 6 six people including my dad himself, mother and four children. He was unable to do so therefore his application couldn't go further.

Now in 2011, we want to continue our previous application as we are now eligible to provide the 'proof of funds' for ourselves but the problem is that two of our siblings (me & my brother) have reached the age of 23 & 22 however we are still full-time students and studying at university level and fully dependent on our parents for financial support.

My question is, Are we still considered dependents according to Canadian Immigration Laws and come under one family application? I am seeking help regarding this issue, I found this community forum quite popular and members are very active. Will be happy to provide more information upon receiving a response.

As per clause 6.4 Family Members of skilled workers page 14


The age of accompanying dependent children is locked in on the date of application, but
dependence is not. If a child is under the age of 22 on the date of application but 22 years of age or
older when the visa is issued, they may still be included as part of the parent's application as an
accompanying dependent, if they are still not married or not in a common-law relationship or, if
they are dependent pursuant to R2(b)(ii). A child who is 22 years of age or older and who is
considered a dependant child on the date of application by virtue of R2(b)(ii) or (iii), i.e. financially
dependent due to full-time study or physical or mental condition, must still meet the requirements of
these provisions at the time of visa issuance in order to be included in the parent's application. See
OP 2, Processing Members of the Family Class, for more information on who qualifies as a dependent
child.


I don't think there will be a problem, just don't marry :)
And if possible consider continuing your studies.

1. Your father has to qualify under the "list of 29" to be eligible: http://www.cic.gc.ca/english/immigrate/skilled/complete-applications.asp 2113 is not on that list.
2. Your old application is dead, you can't continue.
3. You are still considered dependents, but it is a moot point if your father doesn't qualify.

Hi,

That’s so important for me to find the answer, previously thankful for helping.
What is the exact definition of a dependent child who is eligible to be sponsored? The definition of immigration site for children over 22 is not clear.
I worked for a few years after 22, but always supported by family for housing. I’ve been unable to work for some time due to mental condition and mom supports me. Am I eligible to be sponsored by her? Mother & two brothers are in Canada & father is deceased.
