Dear Fellow Members,

I am a Master's student (2 yr program) and due to some extension in my research, I had to seek a study visa extension. I came to Canada in Fall 2014 and applied for extension in late September this year. It is still under process. I also got married in late August this year, i.e., before I applied for study permit extension.

At the same time, my wife who has been working in Canada on her PGWP (post grad work permit), has her visa expiring in coming November. She doesn't have any hope for LMIA so that option is closed. We plan to apply a dependent work permit for her after I get my study permit extension. In my study permit application, I declared that I was married and also uploaded my wife's work visa and TRV as part of required documents. However, when it was asked if she is accompanying me, I said 'NO'. That was because, I thought if I say YES to that question, we will have to provide a marriage certificate. I assumed that she will not a get an open work permit based on my study permit extension, unless that document is provided. However, you may know that after marriage, it takes at least 2 months to get a marriage certificate and that's why I said that she is not accompanying me and went ahead with my study permit application. Now, my study permit extension has still not arrived and I expect it will still take 10 more days, and her visa is expiring in 13 days. I plan to apply for her work permit extension ASAP because now we also got the marriage certificate.

What worried me today was a post on this forum where a lady's PR application under family class was rejected because her husband had declared her a non-accompanying member at the time of getting his PR. The officer said that she was living with her sponsor husband at the time of his PR application and still he said she is a non-accompanying member. So now she cannot get PR under his sponsorship. I am now worried because, I also said that my wife is NOT accompanying me in my application and now I am about to apply for her spouse dependent work visa extension. I hope that is not wrong. My only intention was to wait for the marriage certificate. Should I cancel my study permit application before they process it, and apply again saying that she will accompany me?
