Hi! I have series of questions, I hope somebody can help me.

Dependent child only sponsorship in the Philippines
---I am the father of my 4 y/o son, his mother and I are not married but in good terms. The mother agreed to have my son sponsored here in Canada.

1. do we need to submit custody agreement from court or just an affidavit even if we never got married? Or the Declaration of non-accompanying parent from the mother is enough?
2. Do we need to include in the filing of application the Travel Permit of minors from DSWD?
3. In Application to Sponsor form : In the question Relationship to the principal Applicant: Is it should be CHILD or PARENT? I''m quite confused with this one.

1. A notarized IMM 5604 should be enough. Just make sure you have a valid identification of the mother attached to the form.

2. Not urgent at this time. You may or may not need the Travel Permit (TP). I say "may not" because your child will be getting a PR visa later on. Once a PR visa is issued, you may then check with DSWD if you still need to secure a TP. Just be on the safe side before you take your child and hop on the plane.

3. You are the Parent of your child who is the Principal Applicant :)

Hi, Survivor27! Thank you for your response I was thinking of those, too. But I wanted to make sure that everything's correct and complete to avoid delays. Are we on the same type of sponsorship? How many months did they process your application?

I'm under Spousal Sponsorship but I have dependents. My App is still being simmered :)

Is your name on the birth certificate of the child?

Regardless, they may ask for a DNA test. Don't do this unless they ask, as they will stipulate where you have to go to get it done.

Hi wait so long! Thanks for your response! Yes, my name is on the baby's birth certificate. Are we on the same type of sponsorship? Did they ask for a DNA test?

I've seen a few before and there was one last month (I think) whose sponsorship to the 7-year old child has been approved. It was the mother though who sponsored her child.

Re: TP - this is only needed for the immigration officers at the airport here. As mentioned earlier, since you are sponsoring your son and once he gets a PR visa, I doubt you will still need this. Won't hurt though to check directly with DSWD. But it's pretty clear what they posted on their website:

ARE THE FOLLOWING MINORS EXEMPTED FROM SECURING A TRAVEL CLEARANCE?

  • A minor with permanent residency card
  • A minor who holds a valid pass such as dependents visa/pass/identification or permanent resident visa/pass/identification card is no longer required to secure travel clearance from DSWD. A permanent residency card is a valid pass and a holder of such is exempted from securing a travel clearance.

It's not easy to get a custody agreement as it requires court order which takes minimum 3-4 years according to the lawyer I spoke to before. Just make sure you get the mother to sign the IMM 5604, get it notarized, attach a copy of her valid identification and include everything in your sponsorship package.

You are very much welcome and Thank You as well :) All the best of luck in sponsoring your son. Hoping he gets approved prior to Christmas this year :)
