Hello everyone,
I got divorced 5 years ago.
I have a child from that marriage who is in my ex-wife's custody now.
After my divorce, my ex-wife changed here location taking our child with here, and I don't know anything about them anymore or where they are.
A year ago, I got married again, and I've got another child.

Now I'm applying for NBPNP (provincial nomination) with my new wife and our newly born child accompanying us

Please, I need your help regarding these questions:

  • In what way can my previous marriage affect my application or my future PR?
    • Do I need any documents other than divorce certificate (e.g. my ex-wife's criminal record or medical)?
    • In the application form (NBPNP-020E) I'm requested to attach photos for all family members, however I don't have any for my first child, how can I deal with this?
    • Do I need medical for my first child and or documents other than birth certificate?
    • Do I need passport for my first child?
    • As for proof of funds, do I have to include my first child to in family members (i.e. 3 persons or 4 persons) (bearing in mind that I have no intention or I can accompany my first child with me).
    • My final question is; if I chose not to mention my previous marriage, how can CIC know such information?

Please advise me. Your help will be much appreciated.
Sorry for my bad English

- No, you do not have to provide a medical or police certificates for your ex-wife.
- Yes, your first child technically needs to complete the medical and you need to provide a photocopy of the child's passport and photos. If you cannot locate the child, you will need to provide this information in your application and include documents to show your ex has sole custody. You will need to ask CIC to exclude your first child from the application.
- Technically you should be able to demonstrate proof of funds for 4 people even if one of your children is non-accompanying. However if you manage to get your first child completely dropped from your application, then you will only need to show POF for 3.
- If you fail to disclose your previous marriage and child, it's quite possible CIC will find this information when they conduct background and security checks (background and security checks are conducted for all applications). If your lie is discovered, your application will be refused and you will receive a five year ban from Canada for misrepresentation (i.e. lying in your application).

Thanx scylla for your quick response and your helpful information.
As for documents of custody . I don't know how to get such documents.
My ex got divorced by court and kept the child with her by logic and law, I never claimed or requested custody.
