DENIED OPEN WORK PERMIT APPLICATION

Hi Guys...

I'm just new here so if I posted on the wrong section please bear with me. I just want to share my situation and I hope those experts here will be able to help me figure out what happened to my previous application, and can also help me with my new one.

Last year (around January of 2014), I filed my application for Open Work Permit through my wife who works as a supervisor for a restaurant in Saskatchewan. In less than 2 months I got a response from the CIC in Manila Philippines that states my application is denied. Based on their feedback, the reason why they denied my application was due to the following factors:

* you have not satisfied me that you would leave Canada by the end of the period authorized for your stay. In reaching this decision, I considered several factors, including:

- your family ties in Canada and in your country of residence
- your personal assets and financial status

* Other reasons:

You are or will be unable or unwilling to support yourself or any other person who is dependent on you, and have not satisfied an officer that adequate arrangements for care and support, other than those that involve social assistance, have been made

I would have wanted to upload a screenshot of the actual document for you to see but i am not sure to do so. I will appreciate any information that you can share as I am about to submit my 2nd application and this time, i wanna be sure of the documents as well as the things that i need to do.

What evidence did you provide to show ties to your home country? What evidence did you provide of funds / assets available to support your stay?

Thanks for replying. I completed the forms I was given by an agent we hired. I could not emember which fom it is but it did ask for the names of my parents, siblings, wife and daughters. I was also asked to deposit an amount to my bank account and get some sort of "proof of funds" through bank certification. A friend of mine said that for an application for an open work permit, proof of funds should not be necessary. This made me more confused so I wanna know if it really is necessary or not.

So your wife provided no evidence to show ties to her home country? Evidence would be things like proof of employment, proof of property ownership, etc.

She currently owns a car in Canada. Does she need to include that to her poof of property? We were able to submit her employment Certificate on the first attempt. She did not have any property way back then.

Sorry - my mistake. I thought she was the only applying for the OWP. Since it's you - what evidence did you provide to show that you have tied to your home country and plan to return their after the OWP?

I guess I did not have any evidence except for the fact that my daughters will be left here and that I have my in-laws to take care of them. I don't own any property here in the Philippines. When I initially applied, I showed them a bank certificate that states I have Php15,000 (almost $400) in my bank account. That's the only thing I attached to my application. Other than that, I guess I didn't have anything.

I was advised by a friend who's already in Canada to enclose a letter stating that should I be given the chance to work in Canada, my daughters will be taken cared of by my in-laws.

Do you have a job in the Philippines?

Your funds are extremely low ($400 buys you very little in Canada). If you don't have additional funds to show or additional ties to your home country - I don't think your chances of being approved are very good at all.

So even when you are just applying for an open work permit you're supposed to have so much money? Personally, I kinda think it defeats the purpose of working abroad when you already have a lot of savings in your country but yeah, I guess I'll just add some more on my next attempt. would $1,000 Canadian be enough?

An extra $1K isn't going to make a difference. You would need to show several thousand dollars (and also be able to prove these funds are yours so that CIC knows they haven't just been borrowed from someone just to be approved for a visa). Even if you should these additional funds, I think it's still going to be difficult for you to be approved since you don't appear to have ties you can show to your home country. But you can certainly give it a try.

Your wife's car in Canada has nothing to do with your proof of ties to your home country.
