Hi! I went to canada with working visa as a live in care giver last march of 2012 and had my vacation in the philippines last dec 2012 and supposedly will return last january. My visa got damage and i had to apply for a visa replacement but the immigration officer refused to grant me with the reason "iam not satisfied that you have answered truthfully all questions put to you". i want to appeal for the reason that i honestly answered all the questions asked even if it was really personal. My question is am i already banned for entering canada? cause as i remember the i.o threatens me that he will banned me forever as if iam a criminal. ive done nothing wrong it was an accident that my visa got damaged. if ever i need to apply again can i reapply for the same category as a live in caregiver with same employer? pls help me so depressed right now.

Do you have a valid WP when you sent the application for the replacement of the visa?

Yes i submitted a copy and original WP together with my passport. My TRV will expires on Dec2013 and my WP on March2014. Should I apply for a new TRV? or should I apply for restoration of status? Do I need a new LMO? I don't know what to do.

No restoration but you need a new TRV. The officer could as easily checked the databases for your information/status. Did you already get the refusal for the TRV?

Yes I got my passport 3 weeks after the interview with the refusal letter stating "iam not satisfied that you have answered truthfully all questions put to you" that's it no other reason. I think the decision was so unfair since im only applying for replacement. How can I apply for a new TRV? my employer wants to seek advice from a immigration lawyer. How did it get damaged? The sale of status documents is a huge business and visa officers become suspicious especially if the story does not sound plausible. Unfortunately, you are outside Canada and need a TRV. Apply for your GCMS notes and see if it sheds more light.

I think thats the problem the officer doesnt accept or open to any other reason. Maybe he was thinking of something illegal so he focuses on that thing which is very unfair to me. Anyway thank you for the advise my employer is helping me out by consulting an immigration lawyer. I have clean conscience and i did not do anything bad.

Did you take the ripped page back to the embassy? You may want to find out whether you need a new passport - it should have all its pages.

Hi! I had my vacation last december and scheduled to go back first week of january. Unfortunately my visa got damaged, the page where my visa was totally ripped off. I went to embassy to get a replacement after 2weeks they called me and ask me for an interview. I think the interview didnt really get well since the immigration officer was not convinced with the reason i gave. He keeps on telling me he'll give me another chance to tell what really happened. I already told him the truth to the point that i even cried remembering what happened the frustration, depression, angered and mixed emotion that time. But the IO still not convinced and told me he's thinking something like fraud which is not true. We ended the conversation he told me to wait for my passport it will be delivered to the address i gave. Its a month now and i havent received my passport i dont know if it was cancelled/revoke or it is in the process of getting a new one. How will i know if im still going back to canada? So depressed dont know what to do my employer keep asking me the status.

Yes i did. Actually the visa counterfoil itself has no damage at all it is the page of the passport that was damaged. I already made an affidavit just incase the passport issuing agency needs it for issuing a new passport but then the embassy did not require me to get a new one. Its so depressing especially knowing a non canadian officer did cancelled my visa.
