My friend sent his full documents to ND visa office in April.In June he received a letter from visa officer stating that u r ineligible bcoz u have not sent the employment contract(appointment letter) alongwith full documents.Infact he had sent only the experience certificate mentioning his designation,duties,job timings and pay details.His status now shows eligiblity review complete.Even his application fee has been refunded by CII Novascotia.As soon as he received the eligiblity incomplete letter he sent the appointment letter(employment contract) by speedpost to visa office.But it seems they rejected it.At least visa officer should have given an opportunity to present the needed document.Now should he appeal against this? If so ,whom should he appeal to?Please advise.
 
Yes he must appeal (but with the help of some proffessional immigration lawyer..) as we have seen many such cases here in this forum also who fought back and got justice..

It'll be a tough call for your friend to make it, even after the appeal. 'coz, it was his sheer mistake in the first place & nowadays the process is more of Elimination than Selection.

This was the same question ..I think there must be some case law where it weas held that visa officer should provide seocnd oppertunity to the applicant if his employer is not cooperative
 
It is a very tough call. The rule says we must send all documents at once and should we have issues/problem doing so, a letter/note must be provided with good reasons. If this is not done, VOs/IOs are instructed to base their analysis/verdict on the documents in the applicant's file. This I guess is to fastrack the application process for all waiting applicants.

I am very sorry for your case. Getting a lawyer might not help also however should you get one you might have to pay an hefty sum. I would advise you re-apply if your NOC is still on the list.

Do your friend attached bussiness card of your employer with experience certificate and may be CHC ND verify his employer and they did'nt get verification his experience.
 
Dear friends,thanx for ur prompt replies.Staralihaider sahib,no verification took place VO based his decision on submitted documents.Whatever may b the outcome but we have sent the appeals for reconsideration to immigration minister and Primeminister.However we r not aware about how to appeal to the programme manager of CHC New delhi.It will b of immense help if any forumfriend can enlighten about this.
