So in 30 days I will be able to apply for my citizenship but as most of you, there is no way for me to avoid RQ and scrutiny (I have expired student visa, valid visitor visa and I make a couple of shopping trips there every six months). The most heartbreaking part is that my wife and my son can’t join me here (long story), therefore forcing me to leave Canada in a couple of months. Canada is my home now and I love every little thing about it! It breaks my heart that I will not become citizen of this country.

At 35 years old, I've sacrificed so many things to be here and it hurt me to see them in vain. Since the birth of my son 2.5 years, I have yet to spend a total of 3 weeks with him because I wanted to make sure I reach my goal. My marriage was tested so many times but I still refused to give up on my dream. But today, I have to sleep while my heart is split between abandoning my little family or refusing to sign an application that I am 100% qualified for.

Please cry with me!

Many posts are about this subject, specially if the applicant left to join family members elsewhere. Even though there is no law, the CIC will drag your application until you lose your PR, and then subsequently decline your citizenship application.

Some of the comments are really hard for me to understand, because I have seen plenty of people putting their life on hold just to get Canadian citizenship for lot of reasons. I wanted the same thing and the price that I had to pay was to be away from my family. Due to new circonstances emerging daily, my plan will not really work. So I feel really bad now.

You complain that you are separated from your family and yet you could have easily sponsored them for PR. I find this confusing. I guess you have your reasons for not sponsoring them. However this makes many of us less sympathetic since a big part of the reason you are away from your family is due to choices you have made.

Scylla, I wish they could join me here and I've mentioned that in my first post. In life some people don't have the privilege to just leave everything and move (maybe caring for some one else, important employment...). But I thank you for your response.

Leaving after application doesn't say you don't want to live here, it just says you went somewhere on your business.

There's nothing in the current law preventing doing that, so it's the CIC that tries to be passive-aggressive and play a con-game, but we don't have to be conned into this and be broken in the end.

You may want to take a more level-headed approach, apply and try to stay in process until the end, if possible.

1) try to respond CIC requests on time and appear on test and oath.
2) make sure you can prove your residency in case of RQ
3) try to maintain PR status, 3 years is a long time until expiration, possibly your case will be finalized before expiration.
4) watch the changes in the immigration and citizenship laws and practices.

All questions like what are you doing after application, where are you properties and family etc. are a con game by CIC to discourage applicants, it has nothing to do with conditions to become a citizen under current regulations. It would take a lot of incentive and time to change current Citizenship Act and they maybe would want to try that in the coming years, but for now they have to resort to their passive-aggressive tactics, but the law is on your side.

Maybe OP's family don't want to live in Canada at this time. Once OP became a citizen, however, he can still sponsor them for PR later if family wants to live in Canada while in home country as a Canadian citizen living exclusively outside Canada. I know someone in such situation.

1- I really believe I can show up for all test and oath
2- I have plenty of proof for residency (been working since arrival, bank records, all passports available, rent....)
3- Last year my first PR expired and renewed which will expired at the end of 2016 (I will have lived 1.5 years by the time I leave so that can count toward the new PR card)
4- I don't think it will be any easier in the future in term of immigration laws.

The OP's profile appears to indicate a RQ required on the basis of travel to see family etc as per the first post..I'm presuming the visas mentioned here are for the US.

The ideal scenario is for the OP to sponsor his spouse and child so they could wait out the citizenship application process in Canada. Without knowing all the details which appear outside the scope of this forum then it would be sensible for him to seek legal advice..maybe there is a way.

Pending this EasyRider defines a sensible strategy to approach the Citizenship application. You need a reliable address for CIC correspondence and must be able to return to Canada at short notice for the test and oath. And yes retain your PR at all times.

Apply if you have proof of 1095 physical presence days in Canada.
