CRS (Points) was 390 but still received an OINP notification letter

I submitted my application on CIC on Oct, 2015 and got 390 points. 3 days later I received an OINP letter that encouraged to apply for Ontario Provincial Nominee. But I was confused that my points couldn't meet the criteria of minimum 400. I sent emails to ask experts why I received the letter, they didn't answer my questions clearly.

The deadline of OINP is within 45 days. I didn't take any action at that time.

In April, 2016 my points was automatically updated to 413 on CIC, I decided to apply for OINP, so I sent all documents and required fee to OINP. I am deeply worried that I will be rejected because I missed their deadline.

Please give me directions.

Did you enter both TEF and IELTS results the first time? French speakers are exempted from the 400 points.

Sorry, but OINP will definitely not accept this application. If you do have TEF results, what you should have done is to recreate your Express Entry profile just before you submitted your application to gain a new 45 day window. They have rejected applicants for missing a day or two off the deadline. You are 5 months too late.

If you can manage to cancel the bank draft you sent, or have OINP send back the package, you can create a new profile to get a new PT notification and 45 day window, and you can send a new complete package IF you do get a new PT notification.

Thank you for your so important info.

In my case, do they refund me if my application is rejected just because of missing deadline? if no refund, for sure I need to cancel my draft as soon as possible.

I think ONIP should be responsible for the point mistake. Because I didn't have French test, I was surprised that I could receive letter when my score was under 400. I sent emails to them but they didn't clarify it clearly.

Yes, they will return the application, including the payment. If your package is there already, you can try to email them at ontarionominee@ontario.ca with your name, DoB, date of package arrival, the courier you used, and tracking number to have them return it to you ASAP. Explain that your application is no longer eligible. Otherwise, they will return it to you after 4 months, although I think they will likely return it if you nicely request.

This is the first time I heard of someone getting the PT notification under 400 points and without a French test. Although in the past people with 2-year diplomas got PT notifications, OINP explained that it is still up to the applicant to make sure they are qualified before applying.
