it was my husband (the PA) who had a criminal record. Theft under 5000 and failure to comply from 15 and 14 years ago, both summary
I'm aware of that. And as I said, in this thread, it is the sponsor with a criminal record, so different than your situation.

You if you havee been living together, and in everything you can thar has both your names on it. Bills, bank accounts, lease agreement, insurance.

a lawyer told us we should do our tax together as well. Is that an option. For the banck account do we get a letter at the bank or can we use the online print of our names and address that is on it?

I'm not saying ng 100%you should do this but you could. If you want to get the ball rolling, a record suspension takes up to 6 months, apply for the suspension, wait 1 month and then apply fit the sponsorship, hopefully by the time they get around to the background check, you'll have your record suspension. Bgc comes after eligibility and medical so you should have time depending on your office.
So I totally misunderstood your situation. Your husband who had the record and is wanting to sponsor you, but on the cic website states you cannot sponsor if:
  • were convicted of a violent or sexual offence, or an offence that caused bodily harm to a relative—or you attempted or threatened to commit any of these offence
The sponsor eligibility is the first thing they check, it's completed within a the first month's. Applying without having the RS he could be denied from sponsoring you. Filing taxes and changing from single to married could help the genuineness of your case, yes. It's just my thought, but I would wait for the record suspension before applying or wait for a response from @canuck_in_uk what see whare he thinks, as he's more experienced in this then I am

yes summary and the probation finished in August 2013.
If it was a summary conviction and there was zero violence, then he should be OK to sponsor you. If there was violence involved, then there would be an issue.

You were both legally required to update your marital status with CRA when you married. I suggest you correct that ASAP, as you don't want to mess with CRA.
