Create a new express entry profile after withdrawing a PR application

Hi everyone,

I just realized that although the online application system awarded me additional points for 3 year work experience while I was still 2 weeks away from completing 3 years by the AOR date. This issue is well-known because the questionnaire only asks about the month and year instead of exact dates for each job experience. As a result, I decided to withdraw my current eAPR. I already sent out a CSE to IRCC for withdrawing my application. May I know when I can create a new express entry profile to enter the pool again?

(1) I wait until IRCC replies to me and formally withdraws my eAPR. This could take weeks to months as IRCC is currently very slow in responding requests.
(2) I create a new account and a new express entry profile. I can get ITA early but I will not submit my new eAPR until the old one is formally withdrawn.

Any suggestions on my situation?

The IRCC system calculates work experience by calculating months and not actual days worked in the month. IRCC is aware some applicants are receiving an ITA a month or two early and they advise the candidates not to delay their eAPR or turn down the invitation if the work experience is continuing. If the work genuinely ended before accumulating one year of work, however, they should decline the invitation.

IRCC examining officers are aware of this, and when looking at the application they will take into consideration factors such as the continuous work status, the Offer of Employment Letter from the same employer, and whether the applicant reached the experience required by the time the application is processed.

If you meet all these, you don't need to withdraw your e-APR.

I read a lot of posts on this forum, and many people suggest that if you can't fulfill the number of years (in my case 3 years) by the AOR date, they will round down to a lower level (in my case into 1 year). Then I will lose around 25 points and my CRS score would be below the cut-off point, resulting in a refusal. That's the reason I want to withdraw my e-APR.

In my CSE to IRCC, I explain my situation in the reason for withdrawing stating that my AOR date (Nov 7th) was 2 weeks ahead of the date I fulfill 3-year experience (Nov 21st). If IRCC told me that I don't have to withdraw my case, I will not continue to withdraw. I am still waiting for their reply with a letter for me to sign to confirm the withdrawal request.

Meanwhile, I also made appointments with licensed representatives to consult my current situation. I will update this post with their suggestions.

Also, since I submitted CSE already mentioning my intention to withdraw my application, will they immediately suspend the processing of my case? Or they will wait until I signed the confirmation letter to suspend the processing of my case and withdraw it? I think I am currently still in the queue waiting for MEP/BIL. My AOR date is November 7th, 2020.

I sent out a web form on Nov 23rd, and got a reply on IRCC on Nov 26th as follows:

If you wish to withdraw your application, we invite you to send us a signed written request before a final decision is reached in your file, as follows:

• Submit an IRCC Webform (please attach the signed letter), or
• Send it by mail to the Centralized Intake Office (CIO) in Sydney, Nova Scotia (write Withdrawal of application on the envelope).

In both cases, please include:

• Your full name,
• Your date of birth,
• Your address,
• The date you sent your application,
• Your client ID/UCI (if you have one),
• The type of application (e.g., sponsorship of my spouse),
• The reason for the withdrawal, and
• A copy of the e-Payment receipt or a copy of both sides of the payment receipt form (IMM 5401).

For sponsorship applications only, please also provide the following information about the principal applicant:

• Full name,
• Client ID/UCI (if available), and
• Date of birth.

Important reminder

If your file is being processed outside Canada, please also send your withdrawal request to the responsible visa office.

What happens next?

The office will review your letter and let you know if your request to withdraw has been accepted. Please note that a withdrawal request will only be considered if permanent residence status has not yet been given.

The amount of the refund, if approved, will depend on the processing stage of your application:

• If the processing of your application has not started, you will be refunded the total amount.
• If the processing of your application has started, only the Right of Permanent Residence Fee (RPRF) will be refunded.

If your withdrawal request is accepted, a refund should be issued within 16 weeks. If applicable, it will be given to the person identified as the payer. If it should be given to someone else, you have to give the name and address of that person in your request.

I sent out a web form to withdraw already, and this is the reply I got from IRCC. I haven't sent them the required signed letter. I plan to submit another web form to explain my situation, and hopefully, they can discard my original request to withdraw and continue to process my application.

Hi,

After consulting with several lawyers, I got a consistent answer that the 2-week gap between system calculation and the total number of hours will not lead to a refusal. Your case might be different. Thus I suggest you consult with lawyers to get legal suggestions. In my case, I decided to continue the current application, so I sent another webform to IRCC saying that please discard my previous web form asking for the withdraw of my application.

Update: I got an IRCC reply to my second web form saying that

"We have received your request to cancel the withdrawal of your application. A note was added to your file and we have advised the responsible office."

I also got MEP & BIL today. It seems that they are still processing my application.

I sent my requests to IRCC by web-forms myself. Both web-forms got a reply in 2 business days. Hope this information is helpful to you.
