If someone does not have 730 days yet (still 102 days short) in last five years and CRA send a letter asking to
prove period of presence or send money back. Very much willing to return all money back but that will also disclose the person was not in Canada for 730 days in last five years.

Is there any case CRA reported to immigiration?

I don't know whether they report to CIC, but they are two separate agencies. Residency obligations are different from tax obligations. If you are 102 days short of meeting residency obligations, it's not a problem as long as you do not try to renew your PR card before you have 730 days.

CRA wants to be sure that you were a resident(different from PR) and met other criteria when you received those benefits. If you have proof of your presence submit it, otherwise, consider returning all the money back.

Thanks a lot, atleast I can catch my breath, yes no doubt I am very much willing to return their benefit money. But only I don't want to dislose my shortcoming as things are going so good, I have no intention of apply for PR card or travelling.


Is that be okay, if reply them that " unfortunately I cannot prove my residency days at this moment and therefore willing to return the required amount, grateful if amount can be returned in easy installements"

You may call CRA over the phone and say you will refund the money, then make payment arrangements in installments.

What time period is the CRA letter asking as proof of residence? Does it say the number of years? What money have you received that you know you should not have? Is it a GST credit or Child Benefit?

Offering to pay the money back is a start and you may be lucky CRA let it slide. You may get audited though in the next few Tax Years.

As for CRA bringing this to the attention of CIC depends I can't recall if they have a data sharing agreement though most tax forms mention that info may be shared across government departments. This may be a rational why CIC is asking for Tax Assessments as indicative/ proof of residence for PR Card renewals.

They are asking to pay back for last two years of which one year three months I have confirm proof of residence.

If you have proof of that, by all means submit it. It may help reduce how much you have to remit to CRA.

On another note, if CRA issued cheques only for child benefits, it will limit people receiving benefits(mostly by direct deposit) while outside the country.

Under what cicumstances were you asked to repay tax credits. Was it a result of submitting past 5 years of income tax assessment for PR card application that they realized you were not in Canada for the whole time? Please share your experience,

There was nothing such, CRA has their own way of picking up people for benefit and credit. I didn't apply for PR.

My husband got his pr on june 2007 and he stayed there for 6 months in canada and he got back to india in christmas holidays and he unfortunately met with an accident and have to go for ankle implants removed and he was under treatment for severe complication for his ankle.he was in india since the time he got back from canada.now his canada pr expired in june 2012. he came to dubai in sep 2012 because he got his pr in june 2007 from dubai and he is medical fit now with out any complications and he is planning to go back to canada. please suggest if he can get a travel document on H & C grounds , he has all the medical document for last 5 years of his treatment.he is planning to apply for travel document in abu dhabi

Your husband can apply for a travel document and submit copies of all medical records, physician letters, etc and see how it goes.
