Confusion in applying PR (CEC) from which visa office

Hi All,

I am new to this forum and Find it usefull to have answer of most of questions.

I am currently living in Canada on Work permit. I am eliglible for PR under CEC. I have gathered all documents to apply for the same. But my current work permit is getting expired in NOV-11. Then after I am not sure whether my employer will continue to apply for extention or not.

With this I am thiking to apply from Buffalo office before leaving Canada. So my question is if later I move out from Canada, then what happen to file processing ? will the file be transfered to New Delhi upon request ? I inquired about this question to buffalo office, they replied "We can't trasfer the file to any other office. If later visa interview required then you have to come down at buffalo office"

I am confused here. What to do next ? Becase , if I move out , then I will not be able to come back Canada or US.

I am based out India.

Please advise.

Your employer would apply for an LMO, not a work permit extension. If your employer obtains a positive LMO, then YOU can apply for a work permit extension.

No. All CEC applications are processed in the USA. Even if you wait and apply for CEC after you return to India, you would submit it to New Delhi, but it would be transferred to Buffalo.

That is true. Interviews for CEC are rare, but possible, and they would be held either at Buffalo or one of the other Canadian consulates based in the USA.

In the unlikely event that you were called for an interview, you would have to to get a visa to visit the US. If you were unable to attend the interview, your application would likely be refused.

It's up to you if you want to take that risk. You can check if any of the other programs will work for you (like Federal Skilled Worker), but those are simply the rules for CEC. Your best chance is to ask your employer to apply for a new LMO, renew your work permit, and stay in Canada. But even if you stay in Canada, if you are called for an interview, you would have to travel to the USA.

Just more bit,

Suppose if I apply from Buffalo and If I move out of Canada later, then on later stage when CIC ask to submit passport , medical , where should I do all this ? Can I ask them to submit this to local consulate ?

No. You will have to submit it to Buffalo (or if the file is transferred to another Canadian Consulate in the USA - New York, Detroit, Seattle, Los Angeles - then you would have to submit it there.

You can have the medical done anywhere - the doctor actually submits the results, not you.

So based on your answers , I can say it would be better to apply from New Delhi as at present , I see major time I will spend in India after applying. So even if interview and passport submission later I can handle.

Just small last quick question , if we submit the application to New Delhi and in case , my emplyer will ask me to return back on work permit while PR application is in process. So can I submitt my passport , medical done here in buffalo ? or in this case even I have to submit my passport to NEW DELHI ONLY.

Again, if you submit your application to New Delhi (after you return to India), your file will be transferred to Buffalo. Your interview and passport submission will be to Buffalo, not New Delhi.

There is no choice, whether you are in India or Canada it does not matter, your passport will be submitted to Buffalo (or other US consulate).

Again, you can have the medical done anywhere in the world that you can find a designated medical practitioner.

It looks like to apply under CEC you must have US visa :). I don;t understand then role of local consulate in processing CEC then ?

Yes, it is a rather strange quirk of the CEC program.

If by "local consulate" you mean (in your case) New Delhi, there is NO role in processing CEC applications, beyond accepting it from applicants who no longer live in Canada and forwarding it to Buffalo.

If by "local consulate" you mean one of the other Canadian consulates in the USA, their role is to help Buffalo process its applications.

Can you tell me while PR is in process , can we issue visitor visa to canada from India ?
