Confused! Need your help!

I am really hoping that someone can help me to clarify or can tell me if We have to do something or just wait and not to worry. Please! we recently submitted an inland common law partner application (First week of April) to be exact. But we haven’t heard nor received an AOR yet. I came here as a visitor last 2017, Using Married status even though I have been separated from my ex wife for the last 5 years. On my First and Second extension my lawyer put “UNKNOWN “ on my status. But on the date that you need to specify the date of separation is earlier than the time that I entered Canada. I’ll tell you why. I came from the country where there’s no divorce. I put the date of the legal separation on the form when I moved out of our matrimonial home. But because I don’t have a supporting document and in the Philippines we don’t have an option of Separated when you apply for passport so on my passport I’m still married.

I have been living with my common law partner since I arrived in Canada Dec 2017. I applied for divorce here in Canada and My divorce certificate is ready for pick up.

My question is since I came here with “Married “ status, even though I have been separated since 2012, and I DECLARED it on the FORM from the BEGINNING is this misrepresentation??? I hope not because I am telling the truth. It’s just the law in the Philippines is different from Canada so im really confused and worried since we haven’t heard from them not even AOR. Most of the people that applied in April got their AOR and OWP already. We didn’t use a lawyer on our common law partner application because it is quite expensive.

( First and 2nd extension STATUS “UNKNOWN “) Two extension was granted same thing date of separation was declared.

ALSO, When we applied for common law partner application we only submitted the FILE NUMBER that we got from the court. Should I submit the Divorce Certificate now that we have it even though we haven’t got an AOR yet??? If so where can we submit it? I have a UCI number from my previous application. I’m wondering if this is the reason why we haven’t received an AOR yet. You’re help and advice will be very much appreciated. Thank you in Advance.

If you have a lawyer you've hired for the extension, I'd trust what they are doing. I personally wouldn't have put "unknown" as to the marital status - you were married - and IRCC understands the difficulty of annulment in the Philippines quite well, since it's a very common issue.

Personally, I'd just wait. It can take a couple of months for AOR. If they're going to suggest you misrepresented your status, it won't happen before AOR - it'll happen later. They have to actually receive and process your application before they can determine if they think you misrepresented.

Just wait, don't worry for now.
