Hello members,

So i am currently on a Post graduate work permit, I am thinking of getting my common law partner a work permit as well under mine. My concern is my partner is currently on a student permit but for some personal reasons has not been attending school since October 2018. She has applied to a September intake program and awaiting for a response now(If need be, apply for an extended student permit).

Suppose if i apply for a work permit for her as well and it happens to be rejected by the Immigration officers, what would happen to her status?
Would me applying for a work permit affect her status ?

What would be the best options i have?

It's quite possible that she is already in Canada without status. When students drop out or stop attending school, the school is required to report this to IRCC. Once a student has stopped attending school for more than 90 days, the study permit they hold is generally automatically canceled.

She can try applying for the work permit. This will tell her if she is still in status or not. If the work permit is refused due to her being in Canada without status, she will need to leave Canada and re-apply for the work permit from outside of Canada.

Hopefully she hasn't been working all of this time.
