Hi All,

Here is my situation.

I have applied for two PR applications

I applied for renewal of my open PG work permit under the spousal sponsorship along with my spousal sponsorship PR.
My open PG work permit ended last year in september 2012. Till then I had 9 months of work experience.
I applied for CEC on April 15,2013 ,since I was under implied status from september till now!
But now CIC has been asking me for more proofs to prove that our relationship is genuine and i have already given them everything I had.
And I am afraid I might have to withdraw my spousal sponsorship application which will result in void of my implied status as well.

Now my question is
If my other application gets refused --
Does it effect my CEC application as well since i have been working under implied status from september last year?

Any advise will be helpful.

All documents as in bank statements , will,joint lease and stuf like to prove my relationship and now they want someone to sign the statualry declaration and we both are fairly new and dont really know anyone who would do that for us.

I was on a post grad work permit before i applied for renewal.

Is she your wife or commonlaw partner? Did you have a wedding? Were there your friends and parents? Do you have pictures all together? How long did you know each other before wedding? Do you have mutual friends since you met? Do they know you as a married couple? Did you go for some trips together (even short, for weekend or just a day)? Do you have any pictures with those friends?
Could your neigbours or lanlord sware that you have been living together?
 
we are a common law partner and we dont have any mutual friends .She has some colleagues who know we have been living together and we have already sent there names along .Our families dont know. My siter does and we have sent her details along as well.

But none would be ready to sign a declaration other than my sister and I am not sure how valid will that be?

But I want to know IF this doesnt go through, will my CEC be rejected as well?

According to Canadain imm.rules for considering you commonlaw partners you have to live together 12+ months.

If you parents do not know- you are not partners(you are not a common law FAMILY) and your situation is very suspisious from CIC point of view. You are just boyfriend and girlfriend living together.

You do not have mutual friends? Since SEPTEMBER? It is odd. Really. And it adds more suspitions.
At the first glance- you did not have rights to work since September 2012.
You better go to a lawyer.
 
I filed it through a lawyer , We have filed our taxes together this year...for which you need to be living togther for atleast a year as well.

We know people and we know them since september itself but none is really ready to do sign a declaration though they agreed to have their names on the file. And parents are back home and we are from different religions .we just dont plan to tell them as yet.

And if it gets refused will that void my cec application as well?
How can my work experience not be authorised because i was in implied status ? :(
 
What does the lawyer say about this? You may want to get his/her opinion first before making a decision.

If your friends(or people you know) are not ready to sign a declaration and have reasons, provide those reasons to CIC. There are people who are not comfortable doing that because they don't know if there are legal expectations with that, etc or just don't want to be involved.

If your parents don't know about your relationship, this will be of concern to CIC. Perhaps consider explaining why. Assuming you guys plan to tell your parents some day, might help to include that and when you will.

Why would you want to withdraw your sponsorship? My understanding of implied status is that it continues until CIC makes a decision on an application. Any experience gained on implied status should count. I am not a lawyer, so contact CIC call centre and ask or ask the lawyer.

Do you guys volunteer? Attend church? Is there anyone there willing to sign a declaration?
 
Thats the whole problem here , we dont have anyone who would sign.We know people who might sign but again CIC wants a declaration where they want a declaration from someone who says we have been living together since 2011 , though we have been but to find someone who says yes they have been since then is hard. :(

Should i just send them an application and explain of it?
I am really confused.
 
Do you have a lease agreement or mortgage in both of you names? Can your landlord write a letter confirming you both rent from him/her? Do you have bills in both of your names? I really think you should consult a lawyer.
 
we had a lease in both of our names.

Now she has bought a house. And she me in her will and everything.
Since I am already applying through a lawyer .

I have given him all the documents he asked for /

We have joint accounts , sent them the details , sent them the NOA too which has her as a common law on it.

:( what worries me the most is , If this gets rejected and then my work ex is not counted either for cec.

I will have to do everything from scratch which will be like another one year :(

It is obviously not enough for CIC. And it is understandable. I do not think there are much to will to? Besides there could the next will exist already :D. Bills mean nothing. You can include any of your friends on it- who cares as long as the bill is paid? And yes, sworn declaration is a serious thing in Canada because , mostly, people are honest here, and do not want to swear on things they are not sure of.

Well, it is not still enough. You could buy a house with your friend/relative but it still is not a FAMILY for CIC purposes.

So, there was no wedding
parents do not know
there are no people willing to swear that you are a family......

There is nothing for CIC to believe.

Your lawyer did what you wanted, got money for that and did not (could not!) guarantee you anything. Try another lawyer, of course , just remember the proof is still on you.
