Hi to update after a long absence Since leaving Goverment last year,I had a cooling off period before joining a Private Immigration firm as a Manager.I have kept myself busy as a caregiver advocate at the Provincial and Federal level.Yes I am still on Minister Kenney s Christmas card list,I got one from him again this Christmas.

A caregiver came to for me for help,She is on her open work visa and to the best of her knowlege She was a single Mom for the last 22 years and single for 8 years before that.She left the Philippines for Taiwan 30 years ago as a Single person and became a single Mom 22 years ago and came in as a single Mom to Canada 4 years ago.Now here s the problem,When She came to get her papers from the Philippines Statistics office,She found out that she had a registered marraige to her college boyfriend 30 years ago,apparently as revenge for breaking up with him,He registered a Marraige without her knowlege 30 years ago,So She has now entered Canada under False Pretenses,She is going back to the Philippines to get Affidavits from her Parents and Family that they never knew She was married,They never lived together etc.Plus an Affidavit from the guy He did it to get revenge.I plan to then assist her to file for divorce for the above reasons.Is this enough to show good faith for CIC or should she do more???Masters??Anything else I should tell her to do??By the way this Pro Bono.Thanks

Welcome back BC guy!!!! Anyway, how can a marriage be registered if none happened. No marriage can be solemnized without applying for a marriage license, and there should at least be two witnesses that signed the marriage contract. So there are two documents that if it was not the caregiver who signed, then were forgeries. If the marriage was done by a justice of the peace, the municipality where it was performed would register the marriage, not the couple.

Was she in the Philippines when the so called "marriage" was "solemnized" (sorry, can't think of a better word). If she was not, then that should be proof enough that the marriage never happened and registered certificate is in fact false.

Unfortunately She was in the Philippines in the same city and It is official recorded by the Philippines Vital Statistics office since 1981.So as far as Goverment is concerned She was married

Hello BCguy,

In complement to Job_seeker post, allow me to say that I don't know jack about immigration so my reply will be regarding to the criminal side of your post.
This seems to be a case of ideological falsity and it's crime in any country.

One thing common to any marriage on any country is the need for documents proving single status prior applying for marital union; other is the need for wittiness (usually two for each side) that also are identified by documents. Some countries allow marriages to be performed by legal representation which means, identities are available plus an authorization signed by the part being represented usually along with a letter of explanation of why such representation is needed. As you see you have a traceable record of all involved to be investigated. Including the official, that signs the event.

How to contest it legally? There are several ways like by graph technique tests of her handwriting, which will be compared to the ones on the documents presumably signed by her. It’s done by request of the Police authority, upon receiving a formal complain, also by verification of income taxes declarations, if a property was purchased both names must figure on the deed, etc.,

If her intention is just for immigration purposes, tell her to file a report with the Police, and then write a letter to the immigration office explaining the situation, it's a long shot her allegations must be convincing. Example; Why it took so long for her to find out? What has she done effective upon learning about it? Does she have documented proof of her doings demonstrating that she was never married?

Remember, hell is full of "inocents". honestly, it will be hard and it will take time.
