Commonlaw Spouse I sponsored left me, am I liable for her debts?

PR Status of my formerly commonlaw spouse was approved in Feb of 2013.

She has a credit card, and she is about to accept grants and student loan funding. She has spent over $6000.00 in the last 4 months... I can't afford to be liable for her debts.

Am I liable for her credit card or student loan debts under CIC laws/regulations? Student loans said that I'm not by their standards as I was not a co-signer but rather just her sponsor whose income they had to check for her eligibility.

Also, I am on disability if that helps/changes anything.

Help?

If you sponsored her then you are financially responsible for the next two years. And if the government has given her a loan then they will do anything to get the loan back. I dont know if it helps if you are disabled but the government can turn around and say atleast you are not dead only disabled so better start paying up. You must have signed a paper for financial undertaking when sponsoring her.

As per the undertaking you signed to support the sponsorship you are liable for any welfare/ social assistance she receives between her landing date and 3 years forward to that anniversary. The Government will come for their money one way or other e.g. from eligible tax refunds and they can take their time too. You are not liable for any other debts that you are not a co-signor on. Is the credit card in her sole name or is she an authorized user on your account - if the latter you are on the hook for that money too.

Being disabled doesn't necessarily stop the Government taking action but you can always plead your case. What income are you getting for the disability e.g. WCB.

As her sponsor, you are financially responsible for her for 3 years after she landed as a PR so that is until February 2016. However, this responsibility is only to keep her off welfare so you only have to pay back welfare assistance if she has gotten any. You are not responsible for any debts or loans she gets in her own name as long as you did not co-sign for them.
