Dear all
One of my friends husband is in canada living with his first wife there..my friend wants to go to husband on visit visa..although she has been refused 2 times due to some relationship ties issue..cic rejected her case bcz she applied as friend...now she wants to go there using common law relation with her husband..or is there any possible way so she can apply for any visa??i am afraid she cant apply as a spouse..is it right??

If her husband is married and living with his first wife in Canada - IRCC won't recognize either your friend's marriage or the common law relationship.

If she has already been refused twice, she should not reapply until she is able to demonstrate much stronger ties to her home country.

Thanx a mllion....but is there any other way she could apply??how can she go to her husband??

If she wants to visit Canada, then she should just apply for a visitor visa as a normal tourist (without mentioning her marriage or a common law relationship since these won't be recognized by Canada). To be approved, she will need to show she has strong ties to her home country and has no plans on remaining in Canada long term. It will help if she has past travel to countries requiring visas such as the US and UK.

If she wants to move to Canada permanently (i.e. immigrate) - then she will need to qualify and apply on her own through an economic immigration program like Express Entry / Federal Skilled Worker program. She cannot be sponsored through family class. Again, Canada doesn't recognize her relationship with her husband since bigamy is not legal in Canada.
