Common Law under Canadian Income Tax

My girlfriend and I have been living together for over a year now and we had a baby 4 months ago.
She was born in Canada and I am doing all my immigration paperwork under express entry.
There is this Statutory Declaration of Common law that asks us if we have declared our common law union under the Canadian Income Act.
We never filled a form, we thought we automatically became common law after living together for a year.

Is it necessary to declare that?

CRA doesn't automatically know your marital status. You do actually have to tell them. For CRA purposes, you became common-law after living together for one year OR when your child was born, whichever came first.
