Hi everyone hope you doing good.

I have already applied for Common law sponsorship in august 2021 and have a representative as well but I’m worried about my situation.

im currently out of status.I have been living with my partner since February 2018. My partner got his PR in October 2018 as single. Even though we were living together since February 2018, my partner never changed his address on anything until February 2019.

so when we applied for my sponsorship we provided the lease with both our names dated February 2018 and his address proof from February 2019. Is this going to create a problem? Also on the IMM 0008 form, the common law start date has been written as February 2018 which is the date that we moved in. I asked my representative about this as common law is considered after continuously living together for year. But the representative said it was ok to write the move in date for the date of commonlaw start date.

now I’m super worried because my application has already been sent and I have already
received pre-aor.

will it be an issue for writing the common law start date as February 2018 and my partner got pr in October 2018 as single? Please advise.
Should I withdraw my application?

To be commonlaw you’d have to be living together for a year. So you started living together since Feb 2018 so Feb 2019 is when you are considered “common law”. Them applying in Oct 2018 for PR as single is the right thing. Cause as I said you were not CL till Feb 2019. You are fine :)

Perfect. But while my representative filled out the IMM 0008 form, there is a question asking the common law start date which was filled out as feb 1, 2018 instead of feb 1 2019(which is technically 1year) will that cause any issue?

my representative for some reason said it was right but it’s not. And we have already sent out our application

Did your partner file their taxes as common law and change their status with CRA when they became common law?

It’s more than updated you need to make sure he filed as common law starting in 2019. If you didn’t you have to refile.
Yes we both have definitely filed taxes as common law for both 2019 and 2020. The only issue i have now is the common law start date that has been wrongly typed in the forms as February 1, 2018 (move in date) instead of february 01, 2019 (1 year from move in). As we have already sent out the application i don't know if that would be a problem for us.
