Sorry if this has been asked before, but there is a lot of information on this site and I am struggling to find the answer (before anyone yells at me for asking again)

I am looking into applying for Common-Law Sponsorship.

I am from the UK, my boyfriend is Canadian and we have been together for over a year. We live together, I have government ID's registered at the same address, My T4's, Bank statements, Drivers licence, Photographs and can get reference letters from family and friends to confirm our relationship and also a letter of confirmation from the landlord stating we both live there.

I am on an IEC Working Holiday Visa which expires end of May 2017.

We would have been living together for 1 year from August 2017.

I am looking into applying for the Visitors Visa for End of May.

Question-

I may have to go back to the UK in September where I may apply out-land for the Common-Law Sponsorship as I would be unable to work from May to whenever the OWP would come through if I was to apply In-Land in Canada after August, to which I don't know if my funds would be sufficient enough to have a very extended vacation from working. I am aware that the out-land process could potentially be faster than in-land.

I have been informed on the Facebook forum that I cannot apply out-land for common-law sponsorship if my boyfriend stays in Canada while I go back to the UK for a few months unless he comes with me to the UK. Is this correct??

No, it's NOT correct. Once you qualify as common-law, you can submit an outland application and be apart during the processing.

Ehhhh. Not really. Long gaps (more than a couple of weeks) while you are establishing common-law break it, and would mean you wouldn't qualify. Once CL is established, you can be apart, so long as the relationship itself is enduring.

If you establish common law, then move home, then apply ten years later, you're going to need to supply a lot of proof that your relationship has endured for that time. If you're sure you've established CL, then move out and immediately apply for sponsorship, you should be just fine.
