Common Law Sponsorship - Living together overseas?

Hello Guys,

I am new to this forum, I hope this is the right place to post this question:

Will I be eligible to sponsor my common law partner if we have lived together overseas for 1-2 years?

Background:

I am a Canadian Citizen.

I met and lived together with my GF (From Korea) halfway through her 1 year work vacation VISA (Essentially 5 months together, not enough for common law AFAIK). Her VISA is set to expire this month and we are planning to move together to Australia in January.

If we live together for 1-2 years overseas, are we still eligible to be common law partners for her to be able to come back to Canada?

Or if anyone has any advice on our plans, any help would be great! I am in-experienced with our immigration laws and the immigration consultant we consulted (Korean based) has said our plan should be OK.

Thank you so much!

As long as you live with your girlfriend for a full 365 days, it doesn't matter which country you do it in. Once you have reached one full year, you can then apply to sponsor her. That can be done from whatever country you are living in at that time. Keep up with any and all utility bills / lease agreements / personal letters or gifts, just everything you can get a hold of that shows yours and hers address at the same place.
