Hello all!!
I am needed some help advice direction. I am wanting to apply for common law for my boyfriend. We've been together since 2015 seperated from last March till this October when he returned to Canada. Right now he has approved visitor status until Aug 10 of this year, because he just came back October 11 we can not apply for common law until October 11 2017, which leaves a 2 month gap on in between which leaves me with a what to do situation.

Can I reapply for a visitor extension stating we are applying for the common law PR in October and that is why we need extension, can I apply for extension and if it gets declined but not till after October can I then put in for common law sponsorship. If a decision hasn't been made on the visitor extension and it comes to October can I just put in application for Common law PR.

would greatly appreciate any help or assistance with this :)

when the pr application is submitted has nothing to do with applying for a visitor extension (assuming you're submitting an outland application, which most people should do). you can submit the application as soon as you are commonlaw, whether that's before the current stay ends, while the application for an extension is processing or after the extension request is approved. visitor extensions for PR applicants are rarely denied, so it shouldn't be a factor in deciding when to submit the pr application.

thanks for you're response! I was hoping to do inland so we dont have to be apart again, he's from Greece my son would be crushed as well. I was just concerned with the 2 month gap from when his papers say he can stay here to when I can actually put in for common law. but I will do as stated do the visitor extension noted extension is for PR application
