Common Law - Proof of Cohabitation Questions (UK to Canada)

Hi,

Myself and my partner are putting together our application for Common Law sponsorship to Canada. For context She is a Canadian Citizen and I am from the UK.

As we have moved around a lot in the last year we have a few questions regarding whether our evidence is substantial enough in proving we have lived together for at least 12 months. We have been together 4 years and have lived together for 16 months now.

Our situation is this - We lived together in Montreal for a period of 7 months before we moved to Australia in July 2019. Since last July we have moved at least 8 times. We were always living together but some of these instances were very short term, as in temporary solutions in some cases. Whilst we have evidence for most of these places including lease agreements, bank statements, work contracts, tax documents etc, for other places we don't have much. Here is what we have:

Residence 1 - Utility Bills, Gov issued tax documents, Social insurance, Lease agreement, Joint Banks statement, Home insurance

Residence 2 - Bank correspondence, social insurance documents, medical bill

Residence 3 - Lodging Invoice & Refund *(this is a concern as we only have this due to this being a 2 week period)*

Residence 4 - Booking Invoice (temp accommodation so similar to a lease in this case), medical invoice, payslips, pension documentation

Residence 5 - Medical bills, Payslip, Phone bill, Bank document

Residence 6 - Gym membership agreement w/ address, Lease and Bond agreements, booking receipt w/ address. Except from having my name on the lease agreement, my name is only on an event booking receipt which isn't the strongest piece of evidence, is this too weak?

Residence 7 - Employment contract, medical invoice, payslips

Residence 8 - Phone bill, sublet agreement. * This is a concern as we don't have any other physical proof of us living here*

* I should note that this evidence isn't always joint in terms of us having both names on each document, rather some documents are individual but prove that we lived in the same address at the same time.


Our question is that based on the above, in your opinion do you see this as substantial enough? All of this evidence adds up to more than 12 months but we fear that some of the areas may be too weak in terms of providing physical documents.

I would say that you have good evidence there in my opinion. You have the exact kind of things they want...the official bank/utility/lease etc. My husband and I moved a lot as well and we submitted evidence from when we lived in the UK and when we lived in Canada and different addresses. For example, our utility bill was from our UK address and our bank statement was from our Canada address. We did however, and I suggest you do the same, include a "additional information" sheet included with the relevant form where we explained our situation and how and why we moved during this time. Also remember that you will have to input residential history on your forms.

Along with this though, is that if you applying for the IN Canada route, they also want proof that you are currently living together IN Canada. So make sure you include current co-habitation evidence from Canada. We separated our evidence into two sections, one labeled current co-habitation evidence IN Canada and previous co-habitation evidence UK.

Brilliant thanks for your response. Good idea on separating things. Our final submitted folder is going to be as organised and simplified as possible!
