Common Law partner needs OPW! Help?

If I am a registered Indian on the Canadian Band Lists but not a Canadian citizen (I am a US citizen), that means I can study in Canada without a study permit, which also means I am able to work in Canada without a work permit as stated on the CIC site.

1. I would like my common law partner (together for 2 years, living together for 1 1/2 yrs and he is a US citizen) to come live with me and work while I study in Canada. Could he apply to receive an open work permit since on the site it says that he would not require a regular work permit as long as his partner (me) is allowed to work in Canada for at least 6 months?
2. If he can apply for the open work permit, how would he prove in the application that I am able to study without a permit and therefore work without a permit if I have no permits to take pictures of, or employer at the time to write a statement?
3. Lastly, would I just apply to a school in Canada, receive acceptance, and then have him apply for the open work permit?

The CIC website does not have enough information for me to work with about Registered Indians born in the US unfortunately :(

1. No, he would not be entitled to a work permit. As you are neither a foreign worker nor foreign student in Canada (as per CIC), it means that he is not eligible to apply for a spousal open work permit.
