Hello all!

Ok planning to apply for common law PR outland this summer upon my return to the UK - everything is basically covered - Lease, Bank accounts, Life and car Insurance policies etc.

However! We moved in together on July 16th 2009 and i will have to return to the UK on July 15 2010 - as my year permit will expire...

Will this hurt us? or is the year term flexible by 2 or 3 days?

Any help be great :D

Well none of us can really say how an IO will look at it.
If it was my opinion, it probably wouldn't matter all that much.

However, I think you would be better to make sure you do met that 1 year mark. After all it does say "living continuously for 1 year" so I would go by what they say.
 
You never know how unreasonable an IO is going to be.
 
I'd definitely say it's worth the $75 to extend your stay, even by a few weeks, so you definitely have a full year of cohabitation, as a common-law app depends on that.

If your application for an extension is turned down, you could both go live in the UK for a couple of months. (I'm guessing this will be more expensive just because of airfare.)

Would a IO refuse my stay because of its nature? so we can claim an extra month of living together? I see you can do that online as well - COOL!


Plus does anyone know current processing times for these?

While the extension application is being processed you're allowed to stay in the country under implied status, so even if you're rejected you might be able to stay beyond the expiry of your visa. In any case, it shouldn't be a problem. I was granted six months visiting status when I flew in at Pearson just a few days before my work permit expired. When those months had expired I was on implied status for about two months, after which I was granted another ten. By then I had already gotten my immigration visa, though.

Should i be straight out and honest and say that i want to stay just to fulfill the common law need? or that we are traveling within canada together on holiday?
