I am a Canadian citizen and am looking to apply for common law sponsorship for my Korean citizen partner.
Background:
We met and started a relationship in Canada back in may 2014. However my partner's visa expired in sept 2014 (working holiday) and she went back to Korea to finish her degree. I know this is irrelevant to the 12 month rule since we technically broke it.
In January 2015 we decided to move to Australia together to start our 12 month status. Problem is, we stayed in a nonofficial (no rent lease or formal paperwork) house share until may 2015. We do have letters from our roommates and landowner, and also same mail addresses from the bank/bills but I assume this is not enough proof?
In march 2015 we did sign up for a joint credit card and bank account and have been using it quite often. We then moved to an official rental in june 2015 with joint lease and lots of joint paperwork for the bond and rent receipts etc. We have also have plenty of proof of same mail addresses and lots of photos.
1)Our visa for Australia is set to expire in January 2016. We feel that we have enough proof to apply (flight tickets to australia, visa paperwork etc) but do you think that being in the house share without much paper work will force us to apply at a later date (march for shared cc or June 2016 for rental lease) to get our 12 months?
2)my partner has asked the advice of a Korean visa agency and they suggested to her to apply for visitor or student visa to get entry into Canada and then do an inland common law application around march 2015 when we have sufficient proof. Inland because apparently after stage 1 is approved, she can get a work permit?
3)another option we explored is moving to new Zealand together and do an outland application to speed it up. We both view this as last resort as we want to go back to Canada asap. Would this be a better option?
I would gladly appreciate it if someone has suggestions on what we do with our situation. Should we apply in January 2016 or June 2016 (more proof)? Should she get a student/visitor visa and apply in canada or should we go to new Zealand and apply outland.
