Closed Work Permit refusal ----- Need suggestion Please advise

Hi I got a LMO approval (for 2 years) in Jan 2014 after that we(through representative) have applied for Work permit and it was issued for 6 months due to passport expiry. We have never received the work permit document even though CIC says they have sent couple of times. Don't know what is the issue.

We got to know that my work permit has been expired after 1 months of actual expiry date. So once we got to know about expiry we have re-applied for the work permit with restoration and with the same LMO approval letter. I have been working all these days as per the advise from my Lawyer.

Just today I called CIC to know the status of my work permit application to my surprise they have said that my work permit application has been refused as I have worked without authorization and he asked me to leave the country as soon as possible. Before they refused it they requested to send bank statements of previous 3 months from now. I think they have seen the pay deposits for those 3 months and they have refused my application.

So I am leaving Canada this week but I am looking for an advise from seniors whether there is any chance to come back to Canada and work. If we apply for PR under Canadian experience class will they look into this. Please advise.

It shouldn't have come as any surprise that CIC found you were working without authorization. Since you failed to extend your work permit before it expired, the period from the time it expired to the time to stopped working constitutes working without authorization. It sounds like you were dealing with a poor lawyer. He should have known this.

If you qualify to apply for PR under CEC - you can certainly apply. Note that you cannot use any time worked without authorization towards the one year Canadian work experience requirement.

As for applying for another work permit - you will have to wait until you are outside of Canada for six months before you apply again. Since you were working without authorization, you are disqualified from applying for a work permit for six months.

Thank you so much scylla. It is really helpful. I know I did mistake in trusting a stupid lawyer. I will take your suggestion and apply for PR under CEC with the help of a strong lawyer after going to my home country. Thanks for your help again.
