I've been looking at the paperwork on immigration canada and I find it very confusing. I was born in Canada, and lived here most my life up until 4 years ago when I went to the U.S to live with my then boyfriend who I married while there. I never got an american greencard and was living there illegally. 8 months ago we had a son together. Things fell apart between me and my husband and he basically told me to get out etc. Since I had no american citizenship and no means to support myself or my son there, and wanted to be with my family I came back to Canada. So in august, I crossed the border by land with my 6month old son. My husband had signed papers saying he knew what was going on and allowing us to do so. All my son came across with was a birth certificate, since he didn't yet have a passport.
Now I can't go back into the U.S for 10years since I overstayed my visit when there, so me and my son will be living in Canada permanently. Now when I went to look at the application for citizenship for him, it said I needed "either your childs record of landing (IMM 1000) or confirmation of permanent residence (IMM 5292)...I have neither of those, they don't give you any proof of anything when you cross the border from the U.S to Canada.
So my question is, can he still recieve citizenship without those nescessary documents, and does he need to become a permnent resident first? I thought since I am a citizen he is automatically a citizen from birth?
