Hi,
I’m a British Citizen and I’m in the process for completing a spousal application for PR (Applying from the United Kingdom)..and I’m starting to pull my hair out a little..(There wasn’t much to start with..!)

My wife is a Canadian Citizen from birth (born in Alberta) She has lived with me in England since May 2012. We were married Sepetember 2011 in Canada.
My question is this.

I am obviously the principal applicant, however 4 weeks ago my wife gave birth to our daughter. (She will obviously qualify as a Canadian Citizen as my wife is Canadian.) However we have just realised that to obtain a certificate of Citizenship can take approx 9 months. (We didn’t initially realise we needed one & just assumed she’d be a Canadian Citizen and her birth certificate would enable us to apply for a passport (Canadian)

Should I still submit my spousal sponsorship application PR (and just explain that we are awaiting the citizen certificate for my daughter, she would not even be 1 years old by the time my application should be processed) I can include her birth certificate to prove she is the daughter of a Canadian Citizen i.e my wife & my wifes documentation proves she is a Canadian Citizen from birth)
Otherwise it would mean waiting up to 9 months her so for my babys Citizen Certificate, then submitting my Spousal Application & waiting another 10 months or so. We really wouldn’t want to wait another 2 years nearly to move back to Canada.

Sorry if this isn’t clear guys, any help would be much appreciated. I’ve got most other stuff in the application covered....I think.!
 
For my situation, I submitted my PR application without a Marriage Certificate, as I just got married and they haven't sent it to me yet. What I did do is just scan the Marriage License and put a note that I will send the certificate when I get it.

If you apply inland, the process will most certainly be longer than 9 months, so you perhaps could do the same thing: send in the app with whatever documentation you have about the child with a note, and when you get the birth certificate, send that in after and join it with your original application.

There's no guarantee this will work (and perhaps someone with more experience than I will say don't do this), but that's my opinion.
 
Since your child is Canadian at birth by descent, you can list the child section B of IMM5406 and also add 1 to 6 b) of IMM5481 form.

On back of IMM5481, write down details about the child such as birth date, place of birth, father's name, mother's name, citizenship. Under citizenship, you can explain that you are in process of submitting proof of Canadian citizenship application. Add online receipt as proof that you are doing this.

I had the same issue, my kids were born in US. But since I knew that in order for my kids to get Canadian rights such as SIN, Passport, they need their Canadian citizenship certificate. Canada will not accept any other IDs other than Provincial birth certificates or Canadian citizenship certificate. So as soon as my kids got their minimum docs required to apply for certificate, I sent it in. The website says it can take up to a year to get certificate. I actually gotten them 3 months after I applied. You may not have to wait as long as 9 months. You may get it sooner.

The only time it would take the maximum time to get them is when you already have proof of Canadian citizenship such as birth certificate. If your Canadian wife decided that she wants to have a Canadian citizenship certificate, it would probably take her the max timeline to get it. Whereas your child NEEDED the proof, so the child takes priority. I know this because I wanted a Canadian citizenship card as bonus. It took 1 year after I applied for myself to get it.
